WHEREAS, the U.S. Department of Justice, Office of Community Oriented Policing Services (COPS), advances the practice of community policing in America's state, local and tribal law enforcement agencies by sharing information and providing grant funding to police departments; and
WHEREAS, the 2011 COPS Hiring Program Grant (CHP) has been made available to advance public safety through community policing by addressing the full-time sworn officer needs of state, local, and tribal law enforcement agencies nationwide. This grant is designed to provide jurisdictions with financial support to add or rehire law enforcement personnel vital to effective police operations and other crime reduction strategies consistent with the community policing philosophy; and
WHEREAS, due to a budget deficit, the City of Newark (the "City") was forced to reduce its level of sworn police officers through layoffs; and
WHEREAS, the CHP allows a grantee to use CHP funds to rehire experienced full-time officers, any additional costs higher than entry-level positions that the City pays the rehired officer, must be paid with local/municipal funds, not CHP funds; and
WHEREAS, the City is a Civil Service jurisdiction requiring the City to rehire officers by rank and seniority off the State Certification Special Reemployment List; and
WHEREAS, after receiving thirty-six (36) months of CHP funding, the City is required to retain each CHP-funded position awarded using local, state or other sources of non-CHP funds for at least twelve (12) additional months; and
WHEREAS, the estimated cost to the City to rehire twenty-five (25) officers over the three (3) year grant term and the additional twelve (12) month retention period required by the terms of the grant, is expected not to exceed $3,180,475.00, inclusive of fringe benefits; and
WHEREAS, the City intends to use general funds for the retention period and shall document its plan during the term of this grant; and
WHEREAS, COPS grant funds may not be used to replace State or local funds that would be made available in the absence of federal COPS grant funding. CHP funds must be used to increase the City's law enforcement budget; and
WHEREAS, on May 25, 2011, on behalf of the City of Newark, the Director of Police submitted an application to the U.S. Department of Justice COPS Office requesting grant funding from the 2011 Cops Hiring Program to rehire full-time police officers; and
WHEREAS, as a result of this application, the City of Newark has been awarded a grant in the amount of $6,028,700.00 from the U.S. Department of Justice, Office of Community Oriented Policing Services, to rehire twenty-five (25) full-time police officers for the period commencing on September 1, 2011 and terminating on August 31, 2014; and
WHEREAS, the City must execute a grant agreement with the U.S. Department of Justice in order to obtain the grant award.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

- The Mayor and/or his designee, the Director of Police are hereby authorized to submit an application to the U.S. Department of Justice, Office of Community Oriented Policing Services, requesting grant funding from the 2011 COPS Hiring Program seeking to rehire fifty (50) full-time police officers. (A copy of the application is attached hereto and made a part hereof).
- The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

- The grant award in the amount of $6,028,700.00 from the U.S. Department of Justice, COPS Office, to rehire twenty-five (25) police officers is hereby accepted. (A copy of the award letter is attached hereto and made a part hereof).

- This grant will fund the entry-level salaries of only twenty-five (25) police officers and most fringe benefits for thirty-six (36) months and requires the City to retain these CHP-funded positions for an additional twelve (12) months beyond the grant period. (A copy of the Agreement is attached hereto and made a part hereof).
- The Mayor and/or his designee, the Director of Police are hereby authorized to enter into and execute grant documents with the U.S. Department of Justice, COPS Office to receive and expend the grant award in the amount of $6,028,700.00 to rehire twenty-five (25) full-time police officers for the period commencing on September 1, 2011 and terminating August 31, 2014.

- The agreement between the City of Newark and the U.S. Department of Justice, COPS Office, is hereby ratified from September 1, 2011, to the date of adoption of this authorizing Resolution.
- The City shall be responsible through its municipal budget to pay approximately $292,725.00 annually in budget years 2012, 2013, and 2014 for partial salary costs, and approximately $2,302,300.00 in budget year 2015 for the full cost of the salary and fringe benefits of the twenty-five (25) police officers as per the terms of the grant.

- Matching funds for the first year has been identified in the Operating Budget of the Police Department and shall be provided from the following line appropriation: Fund 011, Department ID# 080, Division Code 081, Account Code 60010. The next two years of the cash match will be identified in the Unclassified Operations-Special Items of Appropriation: Fund 011, Department ID# 230, Division Code 2301.

- The Police Director shall comply with all grant requirements including the statutorily mandated non-supplanting requirements.

- The Director of Police shall file a fully executed copy of the grant application, the grant award letter, and the grant agreement in the Office of City Clerk.
STATEMENT
This resolution ratifies and authorizes the actions taken by the Mayor and/or his designee, the Director of Police to submit an application for grant funding from the U.S. Department of Justice, COPS Office, seeking to rehire fifty (50) full-time police officers, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of Police, to enter into and execute an agreement with and accept grant funds in the amount of $6,028,700.00 from U.S. Department of Justice, COPS Office, to rehire only twenty-five (25) full-time police officers for the period commencing on September 1, 2011through August 31, 2014. This grant will fund the entry-level salaries and most fringe benefits for thirty-six (36) months and requires the City to retain these officers for an additional twelve (12) months beyond the grant period. The entire costs to cover the difference in the salary and fringe benefits to rehire the twenty-five (25) police officers over the three (3) year grant period and the required twelve (12) month retention period from the State Certification Reemployment List is expected not to exceed $3,180,475.00, inclusive of fringe benefits.
