Original Resolution 7R1-l adopted on September 22 2022, awarded a bid contract to provide for Recycling Used Tires Removal Services, for an amount not to exceed $100,000.00, for a period of twenty-four (24) consecutive months.
This amendment will increase the contract amount $100,000.00 for a total contract amount not to exceed $200,000.00 with all other terms and conditions of the original agreement to remain unchanged.

WHEREAS, on September 21, 2022, the Municipal Council adopted Resolution 7R1-l, authorizing the Purchasing Agent, QPA, to enter into a contract with Stage Once Developers, P.O. Box 2148, Linden, New Jersey 07036 to provide for Recycling Used Tires Removal Services, at an amount not to exceed One Hundred Thousand Dollars ad Zero Cents ($100,000.00), for twenty-four (24) consecutive months; and
WHEREAS, the contract with Stage One Developers was executed with the contract term commencing December 5, 2022 and terminating December 4, 2024; and
WHEREAS, within the first month of the contract term, due to the volume of tires throughout the City of Newark (hereinafter the “City”), which require recycling, inclusive of illegally dumped tires, the Department of Public Works (hereinafter the “DPW”), Division of Sanitation, exhausted $78,000.00 of the initial $100,000.00 not to exceed contract amount; and
WHEREAS, as a result of exhausting $78,000.00 of the initial $100,000.00 contract not to exceed amount, the DPW, Division of Sanitation, desires to amend the contract with Stage One Developers, by increasing the total contract amount by and additional One Hundred Thousand Dollars and Zero Cents ($100,000.00), for an increased total not to exceed amount of Two Hundred Thousand Dollars and Zero Cents ($200,000.00, in order to address the ongoing need to remove and recycle tires within the City; and
WHEREAS, the Purchasing Agent, QPA, recommends that the Municipal Council authorize the amendment of Resolution 7R1-I, adopted on September 9, 2022, to increase the not to exceed amount by One Hundred Thousand Dollars ($100,000.00), as requested by the DPW, Division of Sanitation, in the attached memo, for an amended not to exceed amount of Two Hundred Thousand Dollars and Zero Cents ($200, 00.00), with all other terms and condition of the original agreement to remain unchanged.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-l adopted, on September 21, 2022, awarding a contract to Stage Once Developers, P.O. Box 2148, Linden, New Jersey 07036 at an amount not to exceed One Hundred Thousand Dollars ($100,000.00) is hereby amended to increase the contract amount to Two Hundred Thousand Dollars and Zero Cents ($200,000.00).
2. This resolution is ratified from February 1, 2023 to the date of adoption of by the Municipal Council.
3. There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2022 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d).
5. All other terms and conditions of the original agreement shall remain unchanged.
6. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: Department of Public Works, Division of Sanitation NW011-190-1902-83320-B2022. This contract shall not exceed the amended amount of Two Hundred Thousand Dollars and Zero Cents ($200,000.00) for one (1) vendor for the period commencing December 5, 2022 through December 4, 2024, as per the terms and conditions of the original agreement.
7. The Purchasing Agent, QPA shall file a duly executed copy of the contract in the Office of the City Clerk,

If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes and ratifies the amendment of Resolution 7R1-I, adopted September 21, 2022, awarded to Stage One Developers, P.O. Box 2148, Linden, New Jersey 07036, to provide for Recycling Used Tires Removal Services, by increasing the contract not to exceed amount to Two Hundred Thousand Dollars and Zero Cents ($200,000.00), for the contract period commencing December 5, 2022 through December 4, 2024, in order to address the ongoing need to remove and recycle tires within the City of Newark, with all other terms and conditions of the original agreement to remain unchanged.
