Whereas, the City of Newark, through its Agent, wishes to utilize State Contract #T0790 Firefighter Protective Gear, Equipment and Supplies - Statewide to purchase products or services from authorized vendors under the New Jersey Cooperative Purchasing Program 1-NJCP, pursuant to N.J.A.C. 5:34-7.29; and
Whereas, the purchase of goods/services by Local contracting units is authorized by Local Public Contracts Law, N.J.S.A. 40A: 11-12; and
WHEREAS, in accordance with N.J.S.A. 40A:11-11(5), N.J.S.A. 52:25-16.1 et seq. and N.J.A.C. 5:34-7.1 et seq., all Cooperative Purchasing Program participants are responsible for ensuring that the Purchase Order issued reflects the correct contract item pricing and that payment is processed accordingly. Only the items/services specified in the applicable State Contract(s) may be purchased from the contract vendor(s) of record. Cooperative Purchasing participants assume full responsibility for all purchase transactions issued through State Contracts, including Purchase Orders, delivery compliance and payments; and
Whereas, the City wishes to utilize the following State Contracts to purchase Firefighter Protective Clothing and Equipment for the period commencing on March 20, 2026 to March 19, 2030, inclusive of any subsequent extensions granted by the State:

Whereas, the Purchasing Agent recommends the utilization of these State Contract awards on the grounds that they provide Firefighter Protective Clothing and Equipment, according to specifications required by the City of Newark; and
Whereas, usage of this contract provides turnout gear, boots, gloves, helmets, thermal imaging cameras, jaws of life, first aid supplies and other firefighting equipment meeting industry safety standards at a cost not to exceed Three Million Dollars and Zero Cents ($3,000,000.00).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

2. The utilization of these contracts are ratified from June 15, 2019 to the date of adoption of this authorizing resolution.
3. All purchases, Purchase Orders and other related documentation shall be in accordance with the relevant State Contract, New Jersey Standard Terms and Conditions, Method of Operation and Third-Party Agreement, if applicable, as contained in the State Contract documentations and agreements.
4. There shall be no amendment of this resolution without the approval of the Municipal Council.
5. There shall be no advance payment on this State Contract in accordance with N.J.S.A. 40A: 5-16. Funds for purchases each year of this contract are contingent upon appropriations; pursuant to N.J.A.C. 5:30-5.5(c).
6. This contract is awarded as an open-ended contract under N.J.A.C. 5:30-5.3(c). Thus pursuant to N.J.A.C. 5:30-5.5(d)(2), a Certification of the Availability of Funds shall be executed by purchase order each time an order is placed and charged against this contract. This contract shall not exceed Three Million Dollars and Zero Cents ($3,000,000.00).
7. This contract complies with Local Pay-to-Play, N.J.S.A. 19:44A-20.5 as a State Contract award and constitutes a fair and open procedure.
8. The Purchasing Agent shall file a duly executed copy of the contract in the Office of the City Clerk.
9. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such authorization, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the use of State Contract #T0790 Firefighter Protective Clothing and Equipment to permit the Mayor and/or his designees, the Business Administrator or the Purchasing Agent to enter into contracts with AAA Emergency Supply Co Inc, AAH Acquisition LLC, Continental Fire & Safety Inc, Draeger Inc, Fire-Dex LLC, Firefighter One LLC, First Battalion Firefighting Equipment, LLC, Galls LLC, HAIX North America Inc., Howell Rescue Systems Inc., Keyport Army Navy, KOB Solutions LLC, Lions First Responder PPE, Inc., MES Service Company LLC, Morning Pride Manufacturing LLC dba Honeywell First Responder Products, Pi Variables Inc. DBA pi Lit, Ricochet Manufacturing Company Inc., Safeware Inc., Emergency Equipment Sales, LLC., Stanfields, LTD, State Line Fire & Safety Inc., Strategic Safety Dynamics LLC, Tomahawk Strategic Solutions LLC, Viking Life-Saving Equipment, and Witmer Public Safety Group Inc., and all authorized distributors thereunder, for the purchase of Firefighter Protective Gear, Equipment, and Supplies for the Department of Public Safety, Fire Division. This contract shall not exceed Three Million Dollars and Zero Cents ($3,000,000.00) and is for the period commencing upon Municipal Council approval through March 19, 2030, inclusive of any extensions provided by the State.
