WHEREAS, the United States Environmental Protection Agency (USEPA) Brownfields Program provides grants and technical assistance to communities, states, tribes and others to assess, safely clean up and sustainably reuse properties which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminants; and
WHEREAS, the City of Newark (the "City") has determined that there has been, or it suspects that there has been a discharge of hazardous substances or other pollutants or contaminants on the property located in the Target Area and funding is needed to conduct Preliminary Assessments (PAs), Site Investigations (SIs) and site cleanup. The Target Area is the North Ward of Newark Riverfront ("Riverfront"), centered around a heavily industrialized area along the Passaic River. The Target Area is approximately 1,250 acres bounded by the Passaic River to the east, Clifton Avenue to the west, the Newark-Bellville border to the north, and Central Avenue to the south. The Target Area extends along three (3) miles of Passaic River waterfront (the "Property"). Specific sites will be identified by the City and approved by the USEPA before work begins; and
WHEREAS, on January 31, 2019, on behalf of the City, the then designee of the Mayor, the Senior Vice President of Real Estate Development of the Newark Community Economic Development Corporation (NCEDC) submitted an application to the USEPA in response to the competitive Catalog of Federal Domestic Assistance Number announcement 66.818, Brownfields Assessment and Cleanup Cooperative Agreements requesting grant funding in the estimated amount of Six Hundred Thousand Dollars and Zero Cents ($600,000.00), to conduct Preliminary Assessments (PAs), Site Investigation (SIs), site cleanup; and
WHEREAS, as a result of this application, the USEPA has awarded the City a grant in the amount of Six Hundred Thousand Dollars and Zero Cents ($600,000.00) from the Brownfields Grant Program for Preliminary Assessments (PAs), Site Investigations (SIs), and site cleanup for the period commencing October 1, 2019 and terminating on September 30, 2024; and
WHEREAS, the City must execute a grant agreement with the United States Environmental Protection Agency in order to obtain the grant award with Thirty Thousand Dollars and Zero Cents ($30,000.00) City funds required.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to submit an application to the United States Environmental Protection Agency (USEPA) in response to the competitive Catalog of Federal Domestic Assistance Number announcement 66.818, Brownfields Assessment and Cleanup Cooperative Agreements requesting grant funding in the estimated amount of Six Hundred Thousand Dollars and Zero Cents ($600,000.00) to perform Preliminary Assessments (PAs), Site Investigations (SIs), and site cleanup with Thirty Thousand Dollars and Zero Cents ($30,000.00) city funds required (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
3. The grant award in the amount of Six Hundred Thousand Dollars and Zero Cents ($600,000.00) from the United States Environmental Protection Agency is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
4. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to enter into and execute grant documents with the United States Environmental Protection Agency (USEPA) to receive and expend the Brownfields Program grant award in the amount of Six Hundred Thousand Dollars and Zero Cents ($600,000.00) for Preliminary Assessments (PAs), Site Investigations (SIs), and site cleanup on the property identified in the Target Area in the North Ward of Newark Riverfront, centered around a heavily industrialized area along the Passaic River for the period commencing October 1, 2019 and terminating on September 30, 2024 (a copy of the agreement is attached hereto and made a part hereof).
5. The agreement between the City of Newark and the USEPA is hereby ratified from January 31, 2019 to the date of this authorizing resolution.
6. Matching city funds in the amount of Thirty Thousand Dollars ($30,000.00) shall be provided from the following line appropriation: Business Unit: NW027, Dept. A15, Div./Proj. EC5D0, Account #72090, Budget Ref: B2015.
7. The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a fully-executed copy of the grant application, the grant award letter, the grant agreement, and a copy of the Certification of Funds for any required matching funds in the Office of City Clerk.
STATEMENT
This resolution ratifies and authorizes the actions taken by the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to submit an application for grant funding from the USEPA to perform Preliminary Assessments (PAs), Site Investigations (SIs), and site cleanup and furthermore, ratifies and authorizes the Mayor and/or his designee, the Senior Vice President of Real Estate Development of the Newark Community Economic Development Corporation (NCEDC) to enter into and execute an agreement with and accept grant funds in the amount of $600,000.00 from the United States Environmental Protection Agency (USEPA) to perform Preliminary Assessments (PAs), Site Investigations (SIs), and site cleanup on the property identified in the Target Area in the North Ward of Newark Riverfront ("Riverfront"), centered around a heavily industrialized area along the Passaic River. The Target Area is approximately 1,250 acres bounded by the Passaic River to the east, Clifton Avenue to the west, the Newark-Bellville border to the north, and Central Avenue to the south. The Target Area extends along three (3) miles of Passaic River Waterfront, Newark, New Jersey (North Ward). Matching city funds in the amount of $30,000.00 shall be provided from the City budget.
