WHEREAS, the Department of Water and Sewer Utilities (the "Department"), in coordination with the Department of Public Works/Public Buildings, seeks to undertake Contract #07-WS2026 - Roof Replacement at the Archive Building, Chittenden Road Pumping Station, the City Hall Building, the JFK Recreation & Aquatic Center, and the S.W.A.T. Building; and
WHEREAS, the project was publicly advertised on September 23, 2025 and the Department of Water and Sewer Utilities (the "Department") distributed eleven (11) bid packages to prospective bidders; and
WHEREAS, on October 16, 2025, the Department received eight (8) bids for the project in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, the public advertisement and the receipt of public bids and the award of the contract to the lowest responsible bidder, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq. constitutes a Fair and Open Process; and
WHEREAS, the lowest numerical bidder, Westcraft Builders, Inc., represented itself as a WBE entity and listed Park Avenue Building & Roof Supplies, LLC as its MBE subcontractor; and
WHEREAS, upon review, the Department determined that the MBE/WBE certifications submitted by the bidder expired on October 14, 2025, two days prior to the bid opening date of October 16, 2025, thereby rendering the bid non-responsive; and
WHEREAS, after evaluation of all bids received, 6 Brothers Contractors LLC, 41 Algonquin Avenue, Lincoln Park, New Jersey 07035, submitted the lowest responsive and responsible bid in the amount not to exceed $1,096,184.76; and
WHEREAS, the City wishes to accept the lowest responsive and responsible bid submitted by 6 Brothers Contractors LLC, and execute Contract #07-WS2026 - Roof Replacement at the Archive Building, Chittenden Road Pumping Station, the City Hall Building, the JFK Recreation & Aquatic Center, and the S.W.A.T. Building, with 6 Brothers Contractors LLC, 41 Algonquin Avenue, Lincoln Park, New Jersey 07035, total bid amount not to exceed One Million Ninety-Six Thousand One Hundred Eighty Four Dollars and Seventy- Six Cents ($1,096,184.76); and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the Fair and Open Process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, in coordination with the Department of Public Works/Public Buildings are authorized to enter into and execute Contract #07-WS2026-Roof Replacement at the Archive Building, Chittenden Road Pumping Station, the City Hall Building, the JFK Recreation & Aquatic Center, and the S.W.A.T. Building with 6 Brothers Contractors LLC, 41 Algonquin Avenue, Lincoln Park, New Jersey 07035, for bid total amount not to exceed One Million Ninety-Six Thousand One Hundred Eighty Four Dollars and Seventy- Six Cents ($1,096,184.76), the lowest responsive and responsible bidder for a period of 150 calendar days, commencing from the date of the issuance of a written Notice to Proceed.
2. Pursuant to N.J.A.C. 5:30-5.5(a), a Temporary Budget, attached hereto is a partial Certification of Funds from the Chief Financial Officer, which states that funds in the amount of Five Thousand Dollars and Zero Cents ($5,000.00), are available and have been certified in the following accounts: Department of Water and Sewer Utilities, NW037-750-7505-71960 and NW038-800-8007-71970; and Department of Public Works/Public Buildings, 011-060-0604-71670; funds for the JFK Recreation & Aquatic Center roof replacement will be funded by CDBG Housing Community Development Funds 027-A25-EC252-72090 in the amount of $264,738.00 the balance to be provided in the 2026 Adopted Budget. The partial Certification shall be filed along with the Resolution and contract with the Office of the City Clerk.
3. There shall be no amendment or change to the contract without approval by the Municipal Council.
4. The Department of Water and Sewer Utilities shall file a fully executed copy of the contract and Notice to Proceed in the Office of the City Clerk.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, in coordination with the Department of Public Works/Public Buildings to accept the lowest responsive and responsible bid submitted by 6 Brothers Contractors LLC, of 41 Algonquin Avenue, Lincoln Park, New Jersey 07035 on October 16, 2025, and enter into and execute Contract #07-WS2026 for the Roof Replacement at the Archive Building, Chittenden Road Pumping Station, the City Hall Building, the JFK Recreation & Aquatic Center, and the S.W.A.T. Building with 6 Brothers Contractors LLC., for the total bid amount of $1,096,184.76 for a period of 150 calendar days, commencing from the date of the issuance of a written Notice to Proceed.
