WHEREAS, on June 15, 2005, the Municipal Council of the City of Newark adopted Resolution 7Rdo(AS), designating the entire City of Newark as an area in need of rehabilitation; and

 

WHEREAS, on August 7, 2013, the Municipal Council of the City of Newark adopted Ordinance 6PSF-i approving the Newark’s River: Public Access and Redevelopment Plan (the “Original Plan”); and

 

WHEREAS, on October 11, 2017, the Municipal Council of the City of Newark adopted Ordinance 6PSF-f approving the First Amendment to Newark’s River: Public Access and Redevelopment Plan (the “First Amended Plan”); and

 

WHEREAS, the Department of Economic and Housing Development and the Newark Central Planning Board propose the following further changes to the Amended Plan solely as it relates to Lots 30 and 46 in Block 1 (which are located in the Mixed Use 2 (medium density, residential, office, retail) District):

 

(i)                     access driveways shall be permitted uses in adjacent zones,

(ii)                     structured parking (with or without ground floor retail frontage) and interim parking shall be permitted uses, provided that spaces for use by the public to access the riverfront walkway shall be provided, and

(iii)                     no setback, stepback, open space or buffering requirements shall apply as indicated in Exhibit A attached hereto; and

 

WHEREAS, the Municipal Council requests that the Central Planning Board to consider a Second Amendment to the Newark’s River: Public Access and Redevelopment Plan, pursuant to N.J.S.A. 40A:12A-7(f). 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT: 

 

1.                     The Municipal Council hereby directs the Central Planning Board to consider the following changes as a Second Amendment to the Newark’s River: Public Access and Redevelopment Plan, as set forth in Exhibit A attached hereto and made a part of this resolution, pursuant to N.J.S.A. 40A:12A-7(f) solely as it relates to Lots 30 and 46 in Block 1 (which are located in the Mixed Use 2 (medium density, residential, office, retail) District):

 

(i)                     access driveways shall be permitted uses in adjacent zones,

(ii)                     structured parking (with or without ground floor retail frontage) and interim parking shall be permitted uses, provided that spaces for use by the public to access the riverfront walkway shall be provided, and

2.                     This Resolution shall take effect immediately.

 

STATEMENT

 

This resolution requests that the Central Planning Board consider a Second Amendment to the Newark’s River: Public Access and Redevelopment Plan pursuant to N.J.S.A. 40A:12A-7(f).
