WHEREAS, the Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness is desirous of accepting a donation of Essential Baby Gear gifts and entering into a Release and Indemnification Agreement; and
WHEREAS, Baby2Baby, a California not-for-profit corporation, with offices at 5830 W, Jefferson Blvd., Los Angeles, California 90016, has agreed to donate Essential Baby Gear to the City for distribution to families in need and to enter into a Release and Indemnification Agreement; and
WHEREAS, the Municipal Council supports the acceptance of Essential Baby Gear to benefit Newark's youngest residents, and authorizes the execution of a Release and Indemnification Agreement, by the City of Newark Insurance Fund Commission, for the benefit of Baby2Baby, 5830 W. Jefferson Blvd., Los Angeles, California 90016; and
WHEREAS, the City wishes to accept the gift of Essential Baby Gear, pursuant to N.J.S.A. 40A:5-29; and
WHEREAS, the Municipal Council supports the acceptance of this donation under the terms set forth herein.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Health and Community Wellness, is authorized to enter into and execute the Release and Indemnification Agreement and accept the Essential Baby Gear donation from Baby2Baby.
2. No municipal funds will be expended for the acceptance of this gift.
3. The Director of the Department of Health and Community Wellness shall file a copy of the Release and Indemnification Agreement with the Office of the City Clerk.
4. There shall be no amendments to the contract, unless the amendments are in a writing, executed by both parties, and approved by the Municipal Council by Resolution.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness to enter into and execute a Release and Indemnification Agreement and accept a donation of Essential Baby Gear from Baby2Baby, a California not-for-profit corporation, located at 5830 W. Jefferson Blvd., Los Angeles, California 90016.
