WHEREAS, Netflix Production, LLC, 5808 West Sunset Boulevard, Los Angeles, California 90028 would like to donate Ten Thousand Dollars and Zero Cents ($10,000.00) as a “Thank You” for arranging the use of its properties located at 105 St. Charles Street. (Eddie Moraes Stadium) and for supporting the company’s work in the area during the production of the project currently entitled “The 99’ers,” and
WHEREAS, said donation reflects Netflix Production, LLC’s commitment to supporting the City of Newark; and
WHEREAS, the Director of the Department of Recreation, Cultural Affairs & Senior Services (“Department”) desires to accept the Ten-Thousand-Dollar ($10,000.00) donation; and
WHEREAS, the donation will be deposited into the Recreational & Cultural Affairs Activities Trust Fund Account #026-46160; and
WHEREAS, Netflix Production, LLC fully understands and agrees that it is not entitled to receive any direct benefit from the City of Newark, Mayor Ras J. Baraka, or any other personnel affiliated with the City of Newark in exchange for the gift; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept a Ten-Thousand-Dollar ($10,000.00) donation from Netflix Production, LLC, 5805 West Sunset Boulevard, Los Angeles, California, 90028 (“Netflix”), as a “Thank You” for the City of Newark’s (“City’s”) arranging of the use by Netflix of City properties located at 105 St. Charles Street. (Eddie Moraes Stadium) and for supporting Netflix’s work in the area during the production of the project currently entitled, “The 99’ers.”
2. The Municipal Council ratifies its acceptance from the date of the gift to the date of adoption of this authorizing Resolution
3. The City acknowledges the Company’s generous donation of Ten Thousand Dollars and Zero Cents ($10,000.00) through this Resolution.
4. No municipal funds are required for the acceptance of this gift.
5. Pursuant to N.J.S.A 40A:5-15, the donation shall immediately be paid to the Chief Financial Officer, who is directed to credit same to the Recreational Trust Fund.
STATEMENT
This Resolution authorizes the Mayor and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services to accept a $10,000.00 donation from Netflix Production, LLC, 5808 West Sunset Blvd, Los Angeles, California 90028 (“Netflix”), which is made as a “Thank You” for arranging the use of City-of-Newark properties located at 105 St. Charles Street. (Eddie Moraes Stadium) and for supporting Netflix’s work in the area during the production of the project currently entitled, “The 99’ers.” .
