WHEREAS, the Keystone Purchasing Network (KPN), maintains National Cooperative Purchasing Agreement Contracts, which are competitively awarded national leveraged cooperative purchasing contracts, through which members can make purchases; and
WHEREAS, the City of Newark, by joining the KPN, at no cost, can participate in the National Cooperative Purchasing Agreement Contracts to purchase municipal equipment at a competitive bid advantage; and
WHEREAS, the State of New Jersey passed Public Law 2011, Chapter 139, that allows local contracting units to utilize national cooperative contacts as an acceptable procurement method, explained in detail in the New Jersey Department of Community Affairs, Division of Local Government Services, Local Finance Notice No. LFN 2012-10, dated May 14, 2012.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and the Supervising Procurement Specialist, QPA, are authorized to execute a membership agreement with Keystone Purchasing Network (KPN) for the purpose of purchasing from their National Cooperative Purchasing Agreement Contracts.
2. Upon the approval of the above membership agreement by KPN, the City of Newark may elect to make purchases and contract for services through the use of the KPN’s National Cooperative Purchasing Agreement Contracts, however such contract shall not become effective unless and until it is approved by the Newark Municipal Council.
3. All resolutions authorizing purchases and contracts for services through the use of the KPN’s National Cooperative Purchasing Agreement Contracts shall, pursuant to N.J.S.A. 52:34-6.2, set forth that the cooperative purchasing agreement was procured in a fair and open fashion and that the use of the cooperative agreement shall result in costs savings after all factors, including charges for services, material, and delivery, have been considered.
