The City of Newark is responsible for the continued maintenance and repair costs for the serviceable life of the equipment.

WHEREAS, on or about August 14, 2020 the City of Newark (hereinafter the “City”), Department of Public Safety, Division of Fire (hereinafter “Fire Division”) submitted a Letter of Intent (attached hereto) requesting funds from the Leary Firefighters Foundation (hereinafter the “LFF”), located at 14 Murray St. New York, New York 10007, for the purchase of equipment to wash and decontaminate Fire Division structural firefighting gear to remove toxins that can harm the health of firefighters; and

 

WHEREAS, the LFF has made a grant available to the Fire Division (attached hereto) for three (3) Groves - EW30 Extractors and two (2) Groves - Express Dryers (Equipment) to be purchased by the LFF on behalf of the Fire Division; and

 

WHEREAS, as a result of entering into the grant agreement, the LFF is purchasing the three (3) Groves - EW30 Extractors and two (2) Groves - Express Dryers directly from the vendor, New Jersey Fire Equipment, located at 119-131 Route 22 East, Green Brook, NJ 08812 and having the equipment delivered directly to the Fire Divisions Special Services building located at 56 Prospect St. Newark, NJ 07105, as a gift, at no cost to the City. The LFF has provided a no quid pro quo letter (attached hereto); and

 

WHEREAS, the three (3) Groves - EW30 Extractors and two (2) Groves - Express Dryers has a total value of Twenty-three Thousand Three Hundred Sixty Six Dollars  and Zero Cents ($23,366.00). The City is responsible for the continued maintenance and repair costs for the serviceable life of the equipment; and

 

WHEREAS, pursuant to N.J.S.A 40A:5-29, the Department of Public Safety, desires to enter into a grant agreement (attached hereto) to accept the gift of three (3) Groves - EW30 Extractors and two (2) Groves - Express Dryers to aid in the protection of the members of the Fire Division.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or the Director of the Department of Public Safety, is authorized on behalf of the City of Newark, to enter into and execute a grant agreement to accept the donation from the Leary Firefighters Foundation, 14 Murray St. New York, NY 10007, of three (3) Groves - EW30 Extractors and two (2) Groves - Express Dryers, with an approximate total value of Twenty-three Thousand Three Hundred Sixty Six Dollars and Zero Cents ($23,366.00), to aid in the protection of the members of the Fire Division.

 

2.                     No municipal funds shall be expended for the acceptance of this donation, with the exception of continued maintenance and repair costs for the serviceable life of the equipment.

 

3.                     The Director of the Department of Public Safety shall file a copy of the executed grant agreement with the Office of the City Clerk.

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Director of the Department of Public Safety, on behalf of the City of Newark, to enter into a grant agreement and accept the donation of three (3) Groves - EW30 Extractors and two (2) Groves - Express Dryers (Equipment) from the Leary Firefighters Foundation (LFF) located at 14 Murray St. New York, NY 10007, to aid in the protection of the members of the Fire Division.  This donation is at no cost to the City of Newark, with the exception of continued maintenance and repair costs for the serviceable life of the equipment.
