WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provides funds for Local Safety Programs; and

WHEREAS, on April 1, 2014 the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit proposals for the FY 2015-2016 solicitation of the Local Safety and High Risk Rural Roads Program; and

WHEREAS, on May 27, 2014, the City of Newark, Department of Engineering submitted FY 2015-2016 Local Safety Program Proposals to the NJTPA requesting grant funding in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor; and

WHEREAS, as a result of this request, on October 27, 2014 the NJTPA notified the City of Newark that the NJTPA Board of Trustees had approved funding through the FY 2015-2016 Local Safety Program for the Bergen Street Pedestrian Safety Corridor Improvements and requested grant funding in the amount of $902,964.00; and

WHEREAS, on April 20, 2016, the Municipal Council adopted Resolution 7R4-a, which ratified and authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to apply for, accept and enter into a grant agreement for grant funds in the amount of $902,964.00 for the Bergen Street Pedestrian Safety Corridor Improvements; and

WHEREAS, on July 30, 2021, the City of Newark submitted to the NJDOT a cost proposal for the construction inspection services for Bergen Street Pedestrian Safety Corridor Improvements in the amount of $390,196.50 (a copy of the cost proposal is attached hereto and made a part hereof); and

WHEREAS, the City of Newark submitted to NJDOT the plans, specifications and engineering estimate for Bergen Street Pedestrian Safety Corridor Improvements in the amount of $2,663,740.70; and

WHEREAS, on October 28, 2021 NJDOT notified the City of Newark that the Federal Highway Administration (FHWA) authorized funding in the amount of $2,663,740.70 for construction and $390,196.50 for construction inspection for Bergen Street Pedestrian Safety Corridor Improvements (a copy of the October 28, 2021 notification from the NJDOT is attached hereto and made a part hereof); and

WHEREAS, the City of Newark seeks to amend Resolution 7R4-a adopted on April 20, 2016, to accept the additional grant funds to increase the overall project costs of the Bergen Street Pedestrian Safety Corridor Improvements from $902,964.00 to $3,053,937.20 ($2,663,740.70 for Construction and $390,196.50 for Construction Management/Inspection).

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. Resolution 7R4-a, adopted on April 20, 2016, is hereby amended to increase the overall project cost of the Bergen Street Pedestrian Safety Corridor Improvements from $902,964.00 to $3,053,937.20 ($2,663,740.70 for Construction and $390,196.50 for Construction Management/Inspection).

2. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized, on behalf of the City of Newark, to accept the additional grant funds increase from the NJDOT to the overall project costs for the Bergen Street Pedestrian Safety Corridor Improvements.

3. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDOT to increase the overall grant for the project cost of the Bergen Street Pedestrian Safety Corridor Improvements from $902,964.00 to $3,053,937.20 ($2,663,740.70 for Construction and $390,196.50 for Construction Management/Inspection).

4. The agreement between the City of Newark and the NJDOT is hereby ratified from October 28, 2021 to the date of adoption of this authorizing resolution.

5. No municipal funds are required for receipt or acceptance of this grant award.

6. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.


STATEMENT

This Resolution ratifies and authorizes the City of Newark, Department of Engineering, to amend Resolution 7R4-a adopted on April 20, 2016. This resolution further authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to accept grant funds from and enter into and execute an agreement with the NJDOT to increase the grant funding from $902,964.00 to $3,053,937.20 ($2,663,740.70 for Construction and $390,196.50 for Construction Management/Inspection) increasing the overall project costs for the Bergen Street Pedestrian Safety Corridor Improvements. No municipal funds are required for receipt or acceptance of this additional grant funding.
