Additional Information:

This Resolution authorizes the use of Competitive Contracting for the procurement of services for the Newark Community Solutions Program, which is dedicated to the reform and improvement of criminal justice within the City of Newark.

WHEREAS, the City of Newark (“the City”) and its Municipal Court developed a program implementing a community justice initiative based at the Newark Municipal Court House entitled Newark Community Solutions which provides restorative justice solutions for low-level offenders (a copy of the final approved blueprint is attached); and

 

WHEREAS, the City and the Municipal Court desire to use a third-party social service program to operate, manage, and administer the services through the Newark Community Solutions program; and

 

WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) authorizes the use of competitive contracting in lieu of public bidding for the procurement of specialized goods and services for the purpose of operation, management, and administration of a Social Service Program; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiative competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and

 

WHEREAS, the competitive contracting process shall be administered by the Business Administrator, the Qualified Purchasing Agent, in consultation with the Municipal Court, of the City pursuant to N.J.S.A. 40A:11-4.3(b), and any contract awarded under this process shall be made by resolution of the Municipal Council.

 

 

                     NOW, THEREFORE, BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council hereby authorizes the Business Administrator, the Interim Qualified Purchasing Agent, and the Director of the Municipal Courts of the City of Newark to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure services for the operation, management, and administration Social Service Program for a community justice initiative entitled Newark Community Solutions.

 

2.                     The competitive contracting process shall be administered by the Interim Qualified Purchasing Agent of the City of Newark, legal counsel, or the administrator of the contracting unit, pursuant to N.J.S.A. 40A:11-4.3(b).

 

3.                     Any contract awarded under the competitive contracting process shall be made by resolution of the Municipal Council, subject to the provisions of N.J.S.A. 40A:11-4.5.

 

 

 

STATEMENT

 

                     This Resolution authorizes the use of competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure the services for the operation, management, and administration of a Social Service Program for a community justice initiative entitled Newark Community Solutions.
