AN ORDINANCE AMENDING TITLE XXIII, TRAFFIC, CHAPTER 5, PARKING, STOPPING AND STANDING, GENERALLY, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY CREATING SECTION 23:5-16 SCHOOL DROP-OFF AND PICK-UP.

WHEREAS, the Department of Engineering, Division of Traffic and Signals desires to regulate stopping and standing vehicles in relation to drop-off and pick-up of students in Elementary and High School (affecting all City Wards); and
WHEREAS, this Ordinance shall be applicable to all public, private, and charter schools located within the City of Newark’s boarders; and
WHEREAS, the purpose of this Ordinance is designed to protect the health, safety, and welfare of the people of the City in particular all school age children; and
WHEREAS, this Ordinance will now mandate that Class 3 Police Officers are hired by every school in the district on a part-time basis to control the flow of traffic during each schools designated drop-off and pick-up times.
NOW THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, THAT:

SECTION 1. Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is amended and supplemented, to create Section 16, School Drop-off and Pick-up as follows:
CHAPTER 5, Parking, Stopping and Standing
§ 23:5-16 SCHOOL DROP-OFF AND PICK-UP.
Any public, private, or charter school shall prevent any obstruction or interruption of the flow of traffic when students are being dropped off and/or picked up from school:
a. Each school needs to put a plan in place to avoid the obstruction of the flow of traffic and to provide safety measures for their students and staff during drop off and pick up times; and
b. Shall hire a Class 3 Officer part-time, to provide aid and assistance in caring out their plan during the schools designated hours for drop-off and pick-up of students; to protect the health, safety, and welfare of the students and public alike.
SECTION 2. Severability. If any provision of this amendment shall be deemed unenforceable by a Court of competent jurisdiction, the remainder of the amendment shall remain in full force and effect.
SECTION 3. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
SECTION 4: Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.
STATEMENT
This Ordinance amends Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, by creating Section 16 School Drop-off and Pick-up (affecting all City Wards), which requires all public, private, and charter schools to develop a plan for dropping off and picking up students, and hiring a Class 3 Officer to aid in carrying out the plan to prevent the obstruction of traffic and provide safety to the public.
