Resolution 7R5-i adopted on June 04, 2025, authorized a sub-award to Hyacinth Aids Foundation in the amount not to exceed $343,723.00.
This First Amendment will increase the contract amount by $87,000.00, for a new total contract amount not to exceed $430,724.00.

WHEREAS, Resolution 7R5-a adopted on February 19, 2025, authorized the acceptance of Grant Funds in the amount of One Million Seventy-Six Thousand, Nine Hundred Seventeen Dollars and Zero Cents ($1,076,917.00), from the United States Department of Health and Human Services, Health Resources and Services Administration (HRSA), 5600 Fishers Lane, Rockville, Maryland 20857 for the Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program Parts A and B; and
WHEREAS, Resolution 7R5-i adopted on June 04, 2025 (the “Authorizing Resolution”), authorized the execution of an Agreement with Hyacinth Aids Foundation, 201 Washington Street, Newark, New Jersey, 07102 (herein “Sub-recipient”) for a project period from March 1, 2025 through February 28, 2026, in in the amount not to exceed Three-hundred Forty-Three Thousand, Seven Hundred Twenty-Four Dollars and Zero Cents ($343,724.00); and
WHEREAS, Resolution 7R5-a adopted on February 04, 2026 authorized the acceptance of additional grant funds from HRSA increasing the total grant amount received to Five Million, Five Hundred Thirty-Three Thousand, Eight Hundred Forty-Four Dollars and Zero Cents ($5,533,844.00) in addition to a grant period extension from --March 1, 2025 to February 28, 2030; and
WHEREAS, the Sub-recipient, based on rising costs, increase in the number of individuals and families seeking support, has requested additional funding from the City of Newark’s (the “City”) Department of Health and Community Wellness (“DHCW”) to ensure the continuity of housing and support services for individuals and their families in the Newark Eligible Metropolitan Area (NEMA); and
WHEREAS, the requested increase in the total contract amount is deemed reasonable and necessary; and
WHEREAS, the DHCW, based on the submitted request, desires to increase the total award amount to the Sub-recipient by Eighty-Seven Thousand Dollars and Zero Cents ($87,000.00) for an increased total amount not to exceed; and
WHEREAS, the increase in Grant Funds in the amount of Eighty-Seven Thousand Dollars and Zero Cents ($87,000.00), brings the total contract to an amount not to exceed Four Hundred Thirty-Thousand, Seven Hundred Twenty-Four Dollars and Zero Cents ($430,724.00) for the period of March 1, 2025 through February 28, 2026; and
WHEREAS, all other terms and conditions of the sub-award remain the same.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1.The Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, are hereby authorized to enter into and execute a First Amendment to the Agreement with Hyacinth Aids Foundation, 201 Washington Street, Newark, New Jersey, 07102, to provide additional grant funds in the amount of Eighty-Seven Thousand Dollars and Zero Cents ($87,000.00), increasing the total not to exceed amount to Four Hundred Thirty-Thousand, Seven Hundred Twenty-Four Dollars and Zero Cents ($430,724.00) for the grant period commencing March 1, 2025 through February 28, 2026 (a copy of the First Amendment is attached hereto and made a part thereof).
2. The Municipal Council hereby ratifies this First Amendment from the date of the adoption of this Resolution to March 01, 2025.
3. Attached hereto is the Certification, which states funds the amount of Eighty-Seven Thousand Dollars and Zero Cents ($87,000.00), are available in the 2025 Budget, NW051, Dept: G25, Div.: 5h5Q0, Activity: A, Account#: 72090, Budget Ref.: B2025. The Certification shall be filed, along with the Original Resolution and the executed First Amendment contract in the Office of the City Clerk.
4. There shall be no advance payments on the Agreement in accordance with N.J.S.A. 40A:5-16. Funds for 2023 and subsequent years are contingent upon appropriations, pursuant to N.J. A.C. 5:30-5.5(d) (2).

5.There shall be no amendments or changes to the contract without the approval of the Municipal Council by Resolution.
6. All other terms and conditions of the Agreement remain the same.
7. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the First Amendment to the contract and the Certification of Funds in the Office of the City Clerk.
STATEMENT
This Resolution ratifies, amends, and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to enter into and execute a First Amendment to the Agreement to provide housing and support services for individuals and their families in the Newark Eligible Metropolitan Area (NEMA) with Hyacinth Aids Foundation, 201 Washington Street, Newark, New Jersey, 07102, amending the Contract Amount by an additional Eighty-Seven Thousand Dollars and Zero Cents ($87,000.00), for a total Contract Amount not to exceed Four Hundred Thirty Thousand Seven Hundred Twenty‑Four Dollars and Zero Cents ($430,724.00) for the period of March 1, 2025 through February 28, 2026.
