WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $1,518,881.54 for the SuNuP Food Service Program, and no adequate provision has been made in the 2020 Temporary Budget for the aforesaid purpose, and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the same; and
WHEREAS, by the award letter dated April 3, 2020, the New Jersey Department of Agriculture, Division of Food and Nutrition, Summer Food Program, has awarded the City, the SuNuP Food Service Grant, in the amount of $1,518,881.54. The aforementioned program will provide free, nutritious meals, and snacks to children who live in areas in which at least 50% of said population qualify for free or reduced-price meals under the National School Lunch Program within the City of Newark; and
WHEREAS, the City’s Department of Recreation, Cultural Affairs and Senior Services will be submitting, contemporaneously, the companion Apply and Accept Resolution for this grant award for Municipal Council approval; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2020 pursuant to N.J.S.A. 40A:4-20, including this resolution, total $213,575,462.78
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. A temporary emergency appropriation be and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2020 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This resolution authorizes and establishes the temporary emergency appropriation for the SuNuP Food Service Program in the amount of $1,518,881.54. The New Jersey Department of Agriculture, Division of Food and Nutrition, Summer Food Program has awarded the City of Newark the SuNuP Food Grant. The project period is October 1, 2019 through September 30, 2020.
