WHEREAS, in an effort to enhance our local intermodal system, expand travel choice, strengthen our local economy, improve our quality of life and protect the environment, the City of Newark Department of Engineering, Division of Traffic and Signals, is seeking a Resolution of Support to submit an application to receive funding from the New Jersey Department of Transportation (“NJDOT”) Transportation Alternatives Program (TAP); and

 

WHEREAS, NJDOT’s Transportation Alternatives Program provides federal funds for community based “non-traditional” surface transportation projects designed to strengthen the cultural, aesthetic, and environmental aspects of the nation’s intermodal system; and

 

WHEREAS, this federally funded program is administered by NJDOT in partnership with the North Jersey Transportation Planning Authority, the Delaware Valley Regional Planning Commission and the South Jersey Transportation Planning Organization; and

 

                     WHEREAS, the City of Newark Department of Engineering, Division of Traffic and Signals, has identified a project that fits the eligible criteria established by the NJDOT and desires the support of the Municipal Council for the Peter Francisco Park Improvement Project; and

 

                     WHEREAS, the Peter Francisco Park Improvement project presents a vision of comfortable, convenient and safe environment in Newark’s Ironbound neighborhood for all commuters and residential use that also establishes a framework for improving transportation in the Ironbound; and

 

                     WHEREAS, the recommended streetscape infrastructure improvements and sustainable elements of this project are result of extensive community outreach and technical analysis These improvements will make commuting for all users safe, improve the quality of life for residents and visitors by making the area more aesthetically and functionally pleasing; and

 

                     WHEREAS, the NJDOT recognizes that local support is critical and necessary for the implementation of eligible projects and has required communities seeking funding from TAP to obtain a Resolution of Support to assure them that all local entities affected by this undertaking are on board with the construction and long-term maintenance of the project. In addition, NJDOT recognizes the importance of public feedback and encourages their participation in the process where it’s most appropriate; and

 

                     WHEREAS, upon notification of the receipt of a grant award in connection with this application, the City of Newark Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and

 

                     WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Municipal Council hereby affirms this Resolution of Support of the City of Newark, Department of Engineering, Division of Traffic and Signals, Peter Francisco Park Improvement Project.

2.                     The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an application to the New Jersey Department of Transportation as part of the Transportation Alternatives Program requesting grant funding for the Peter Francisco Park Improvement Project with 20% City matching funds required.

3.                     Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.

 

4.                     Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award for the Peter Francisco Park Improvement Project

 

5.                     Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents as well as a copy of the Certification of Funds for any required matching funds to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

 

6.                     The Director of the Department of Engineering shall file a fully-executed copy of the grant application, the grant award letter, the grant agreement, and a copy of the Certification of Funds for any required matching funds in the Office of the City Clerk.

 

STATEMENT

 

The City of Newark Municipal Council hereby affirms this Resolution of Support to the Department of Engineering, Division of Traffic and Signals, for the submission of a grant application, and to accept, and enter into an agreement for grant funding from the New Jersey Department of Transportation (“NJDOT”) Transportation Alternatives Program and authorizes the Mayor and/or his designee, the Director of Engineering, to receive and expend the grant award for the Peter Francisco Park Improvement Project.
