WHEREAS, an emergency has arisen stemming from the impact of Winter Storm Jonas with respect to clean up mandates and unforeseen changes in contractual obligations by the New Jersey Department of Environmental Protection (NJDEP), and adequate provisions have not been made in the 2016 Budget for the aforesaid purposes. N.J.S.A. 40A:40-46 provides for the creation of an emergency appropriation for the purposes mentioned above; and

 

                      WHEREAS, the total amount of the emergency appropriations created, including the appropriation to be created by this resolution is $12,131,901.00 and three (3) percent of the total operating appropriations in the budget for 2016 is $17,200,532.00; and

 

                     WHEREAS, the foregoing appropriation, together with prior appropriations, does not exceed three (3) percent of the total operating appropriations (including utility operating appropriations) in the budget for 2016.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     An emergency appropriation be and the same is hereby made for the

following purposes and amounts:

 

                     NJDEP required compost Remediation                      $1,212,700.00

 

                     NJDEP required Tire Removal                                                 300,000.00

 

                     Revised Negotiated Contract                                           244,000.00

 

                     Winter Storm Jonas                                                                    2,972,785.00

 

                     Winter Storm Jonas Tree Removal              711,100.00

 

                     TOTAL                                                                  $5,440,585.00

 

2.                     That said emergency appropriation shall be provided for in full in the 2017 budget, and is requested to be excluded from CAPS, pursuant to N.J.S.A. 40A:4-53.3c(1).

 

3.                     A copy of this resolution shall be filed with the Director of the Division of Local Government Services by the City Clerk of the City of Newark.

 

STATEMENT

 

This resolution establishes additional emergency appropriation in the 2016 Municipal Budget in the amount of $5,440,585.00 for other expenses in the Department of Public Works to pay for expenses related to 2016 Winter Storm Jonas, unforeseen changes in contractual obligations and actions mandated by New Jersey Department of Environmental Protection.
