This Resolution will amend Resolution 7R3-d, adopted on December 6, 2023, by increasing the grant funding from $5,663,005.13 to $6,929,474.35 ($5,922,480.79 for construction and $1,006,993.56 for construction inspection), by accepting additional funding in amount of $1,266,469.22.

            WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provides funds for Local Safety Programs; and

 

                     WHEREAS, on June 15, 2015, the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit proposals for the FY 2016-2017 solicitation of the Local Safety and High Risk Rural Roads Program; and

 

WHEREAS, on September 1, 2015, the City of Newark, Department of Engineering, submitted a proposal for the FY 2016-2017 Local Safety High Risk Rural Roads Program to the North Jersey Transportation Planning Authority (NJTPA), for the Ferry Street Pedestrian Safety Corridor Improvements project, requesting grant funding in the amount of Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00); and

                     

WHEREAS, as a result of this proposal, the City of Newark was notified on February 25, 2016, by NJTPA that the City had been approved for grant funding through the FY 2016-2017 Local Safety High-Risk Rural Roads Program for the Ferry Street Pedestrian Safety Corridor Improvements project, in the amount of Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00); and

 

                     WHEREAS, on June 15, 2016, the Municipal Council adopted Resolution 7R4-b, which ratified and authorized the City of Newark to apply for and accept grant funds in the amount of Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00) for the Ferry Street Pedestrian Safety Corridor Improvements project; and

 

           WHEREAS, on May 23, 2023, the City of Newark submitted to NJDOT a cost proposal for the construction inspection services for the Ferry Street Pedestrian Safety Corridor Improvements project in the amount of One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56); and

 

           WHEREAS, on July 26, 2023, the City of Newark submitted to NJDOT the plans, specifications, and engineering estimate for the  Ferry Street Pedestrian Safety Corridor Improvements project in the amount of Four Million Six Hundred Fifty-Six Thousand, Eleven Dollars and Fifty-Seven Cents ($4,656,011.57); and

       

           WHEREAS, on August 22, 2023, the Federal Highway Administration (FHWA) authorized funding in the amount of Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), Four Million Six Hundred Fifty-Six Thousand Eleven Dollars and Fifty-Seven Cents ($4,656,011.57) for construction  and  One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56), for construction inspection and management services) for the Ferry Street Pedestrian Safety Corridor Improvements project; and

 

          WHEREAS, on December 6,2023 the City amended Resolution 7R4-b adopted on June 15, 2016 and  accepted the additional grant funds for the Ferry Street Pedestrian Safety Corridor Improvements project from Two Million Seven Hundred Three Thousand Dollars and Zero Cents ($2,703,000.00) to Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13), Four Million Six Hundred Fifty-Six Thousand Eleven Dollars and Fifty-Seven Cents ($4,656,011.57) for construction and One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56) for construction inspection and management services and  enter into and execute a Federal Aid Cost Reimbursement Agreement No. 2023-DT-BLA-206 with the New Jersey Department of Transportation, Division of Local Aid and Economic Development and;

 

          WHEREAS, on February 14, 2024, the City of Newark, Department of Engineering held a public bid opening for Ferry Street Intersection Safety Improvements  project, Contract #2022-06, Federal Project number HSP-1844 (301) and based on a review of the bids, the lowest responsive and responsible bidder Berto Construction Inc., was selected for Ferry Street Safety Improvements Federal Project for the total bid amount not to exceed Five Million Nine Hundred Ninety-Nine Hundreds, Nine Hundred, Ten Dollars and Seventy-Nine Cents ($5,999,910.79) and;

 

          WHEREAS, on May 30, 2024 the City of Newark, Department of Engineering requested additional One Million Two Hundred Sixty-Six thousand Four Hundred, Sixty-Nine Dollars and Twenty-Two Cents ($1,266,469.22) needed for Ferry Street Safety Improvements Federal Project and;

 

           WHEREAS, on June 18, 2024 Federal Highway Administration (FHWA) approved an additional One Million Two Hundred Sixty-Six Thousand Four Hundred, Sixty- Nine Dollars and Twenty-Two Cents ($1,266,469.22) needed for Ferry Street Safety Improvements Federal Project and funding  for Ferry Street Intersection Safety  Improvements Project and;

 

           WHEREAS, the City of Newark seeks to amend Resolution 7R3-d adopted on December 6, 2023 to accept the additional grant funds for the Ferry Street Pedestrian Safety Corridor Improvements project from to Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13) to Six Million , Nine Hundred Twenty- Nine Thousand , Four Hundred Seventy-Four Dollars and Thirty-Five Cents ($6,929,474.35),Five Million Nine Hundred Twenty-Two Thousand Four Hundred Eighty Dollars and Seventy-Nine Cents ($5,922,480.79) for construction and One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56) for construction inspection and management services by accepting additional funds in the amount of One Million Two Hundred Sixty- Six Thousand Four Hundred Seventy Four Dollars and Twenty-Two Cents ($1,266,469.22).           

 

 

        NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     Resolution 7R3-d, adopted on December 6, 2023, is hereby amended to increase the overall project cost of the Ferry Street Pedestrian Safety Corridor Improvements from Five Million Six Hundred Sixty-Three Thousand Five Dollars and Thirteen Cents ($5,663,005.13) to Six Million, Nine Hundred Twenty-Nine Thousand, Four Hundred Seventy-Four Dollars and Thirty-Five Cents ($6,929,474.35) Five Million Nine Hundred Twenty-Two Thousand Four Hundred Eighty Dollars and Seventy-Nine Cents ($5,922,480.79) for construction and One Million Six Thousand Nine Hundred Ninety-Three Dollars and Fifty-Six Cents ($1,006,993.56)  for construction inspection and management services, with no municipal funds required.

 

2.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized, on behalf of the City of Newark, to accept the additional grant funds from the New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT) for the Ferry Street Pedestrian Safety Corridor Improvements project in the amount of One Million Two Hundred Sixty- Six Thousand Four Hundred Seventy Four Dollars and Twenty-Two Cents ($1,266,469.22) with no municipal funds required (a copy of the NJDOT grant award letter is attached hereto and made a part hereof).

 

3.                     The Municipal Council hereby ratifies its acceptance of these grant funds from December 6, 2023 to the date of adoption of this authorizing Resolution.

 

4.                     No municipal funds are required for receipt or acceptance of this grant award.

 

5.                     No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.

 

6.                     The Director of the Department of Engineering shall file a fully executed copy of the grant application, grant award letter, the final authorization letter, and grant/project agreement in the Office of the City Clerk.
