WHEREAS, Original Resolution 7R3-a, adopted on October 18, 2023, authorized the Department of Engineering to enter into a contract with Suburban Consulting Engineers, Inc., to provide engineering services to prepare Design and Bid Documents and handle Construction Management for the renovation of the Ironbound Little League Turf Field at 441-455 Chestnut Street, Newark, New Jersey 07102 (“Project”), in an amount not to exceed Fifty-Five Thousand Nine Hundred Dollars and Zero Cents ($55,900.00) for a period of one (1) year from the date of a written Notice to Proceed; and
WHEREAS, during the design process, samples were taken from the Project site to obtain the proper waste disposal classification of the soil, which revealed that the soil contained elevated levels of benzo(a)pyrene and lead. As a result, additional soil samples and testing are required, which will cost approximately Thirty-One Thousand Two Hundred Dollars and Zero Cents ($31,200.00); and
WHEREAS, the Acting Director of the Department of Engineering wishes to enter into and execute Change Order #1 to Contract #2022-02PS with Suburban Consulting Engineers, Inc., to increase the contract amount by Thirty-One Thousand Two Hundred Dollars and Zero Cents ($31,200.00) for additional soil testing, for a new total contract amount not to exceed Eighty Seven Thousand One Hundred Dollars and Zero Cents ($87,100.00); and
WHEREAS, the award of this Change Order is in accordance with the procedures for the award of a Professional Service pursuant to N.J.S.A. 40A:11-5(1)(a)(i) and the Fair and Open procedures of the New Jersey Local Unit Pay-to-Play Law N.J.S.A. 19:44A-20.5, and N.J.A.C. 5:30-11 et seq.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized and directed on behalf of the City of Newark to enter into and execute Change Order #1 with Suburban Consulting Engineers, Inc., 96 US Highway 206, Suite #101, Flanders, New Jersey 07836, to Contract #2022-02PS Renovation of the Ironbound Little League Turf Field at 441-455 Chestnut Street, which will increase the contract amount by Thirty-One Thousand Two Hundred Dollars and Zero Cents ($31,200.00) for additional soil testing, for a new total contract amount not to exceed Eighty Seven Thousand One Hundred Dollars and Zero Cents ($87,100.00).
2. The Municipal Council hereby ratifies this Change Order/Contract Amendment to Contract #2022-02PS from the date of Contract Amendment to the date of adoption of this authorizing Resolution.
3. No other changes to this contract are allowed without prior Municipal Council approval.
4. This contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law N.J.S.A. 19:44A-20.5, and pursuant to the provisions of the Local Public Contracts Law N.J.S.A. 40A:11-5(1)(a)(i), and is in compliance with the City of Newark Municipal Code § 2:4-22C.1, which adopted the State of New Jersey's Pay-to-Play statutory requirements pursuant to N.J.S.A. 19:44A-20.5, as may be amended and supplemented, governing eligibility for municipal contracts.
5. Attached hereto is the Comptroller’s Certification, which states: (1) that there are available sufficient legally appropriated funds in the amount of Thirty-One Thousand Two Hundred Dollars and Zero Cents ($31,200.00), for the purposes set forth herein, and the line appropriation of the official budget which shall be charged is as follows:

6. There shall be no amendments or changes to this contract without prior approval of the Municipal Council and there shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
7. A copy of the executed agreement herein authorized shall be filed in the Office of the City Clerk by the Acting Director of the Department of Engineering and shall be made available for public inspection.
