WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(k), competitive contracting may be used by local contracting units in lieu of public bidding for the procurement of specialized goods and services the price of which exceeds the bid threshold; and
WHEREAS, pursuant to N.J.A.C. 5:33-1.1, electronic municipal tax lien service may be procured through competitive contracting without seeking prior approval of the Director of the Division of Local Government Services; and
WHEREAS, Resolution 7R1-f adopted on February 20, 2019 ratified the use of competitive contracting for Online Tax Sale Hosting Services; and
WHEREAS, on September 13, 2023, the City’s Purchasing Agent, QPA publicly advertised a Request For Proposals (RFPs) to procure Online Tax Sale Hosting Services, pursuant to N.J.S.A. 40A:11-4.3(a); and
WHEREAS, on October 5, 2023, the City’s Purchasing Agent, QPA, received a proposal from one (1) vendor and publicly opened and read aloud the name and address of the vendor who submitted the proposal package on the advertised deadline; and
WHEREAS, a three (3) member Evaluation Committee was formed to review the proposal submitted by said vendor and to make a recommendation, as outlined in the Specifications to the Department of Finance, Division of Revenue Collection; and
WHEREAS, the City’s Purchasing Agent, QPA, obtained signed no-conflict letters from the members of the evaluation committee (copies of which are attached here to and made a part hereof) before delivering the vendor’s proposal package for review and; and
WHEREAS, the evaluation committee, pursuant to N.J.S.A. 40A:11-4.5, recommended to the Qualified Purchasing Agent an award be made to Realauction.com, LLC, 861 Southwest 78th Avenue, Suite B-102, Plantation, Florida 33324 (“Realauction LLC”) to provide Online Tax Sale Hosting Services; and
WHEREAS, the City’s Purchasing Agent, QPA, accepts said recommendation; and
WHEREAS, the City’s Purchasing Agent, QPA, issued an evaluation and recommendation report, pursuant N.J.S.A. 40A:11-4.5(d); and
WHEREAS, this contract is to be used to solicit sealed proposals to host the City of Newark’s Online Tax Sales at an amount not to exceed, Five Hundred Thousand Dollars and Zero Cents ($500,000.00); and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the vendor consented to holding its bid for consideration until such time as an award is made, as the law permits; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5, solicitations through competitive contracting in accordance with N.J.S.A. 40A:11-4.1 et seq. meet the requirements of a Fair and Open Process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Business Administrator, are hereby authorized to enter into and execute a contract with Realauction.com, LLC, 861 Southwest 78th Avenue, Suite B-102, Plantation, Florida 33324 to provide solicited sealed proposals to host the City of Newark’s Online Tax Sales. The contract term will be for a period not to exceed twenty-four (24) consecutive months. The contract amount shall not exceed Five Hundred Thousand Dollars and Zero Cents ($500,000.00).
2. There shall be no amendment or change of this contract without the approval of the Municipal Council by Resolution.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. All payments under this contract shall be contingent upon the availability and appropriation of funds, pursuant to N.J.A.C. 5:30-5.5(a)(2) and (d)(2).
4. This is an open-ended contract to be used as needed during the term of the contract. Any and all expenditures against this contract shall be encumbered pursuant to N.J.A.C. 5:30-5.5(b)(2) using the following budgetary account: NW-026-32100 B2024.
5. The City’s Purchasing Agent, QPA, shall forthwith file a duly executed copy of the contract in the Office of the City Clerk.
6. If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following this award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller, dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Business Administrator to enter into and execute a contract with Realauction.com, LLC, 861 Southwest 78th Avenue, Suite B-102, Plantation, Florida 33324, to provide solicited sealed proposals to host the City of Newark’s Online Tax Sales to the City’s Department of Finance, Division of Revenue Collection, at a cost not to exceed Five Hundred Thousand Dollars and Zero Cents ($500,000.00). The term of the contract is for a period not to exceed twenty-four (24) months.
