WHEREAS, the City of Newark (the City) has offered the Italian American War Veterans of the United States the use of Room B-28 in City Hall for the organization along with several other Newark based veterans service organizations to reestablish the Commission for Veteran’s Affairs, which will assist veterans who are homeless, unemployed, and suffering from various health and psychological problems like Traumatic Brain Injury and Post Traumatic Stress Disorder; and

 

WHEREAS,  The Home Depot, Store 0980, 399-443 Springfield Avenue, Newark, New Jersey 07103, is providing materials and labor for the rehabilitation of Room B-28 in City Hall through their Team Depot program; and

 

WHEREAS, the work consists of the rehabilitation to three (3) offices to be performed under the direction of the Director of Engineering (a copy of a letter describing the work to be performed is attached); and

 

WHEREAS, the gift of materials and labor is valued at ten thousand six hundred three dollars and eighty-seven cents ($10,603.87) (The Home Depot quotes attached); and

 

WHEREAS, the Mayor, the Director of Engineering, and Municipal Council believe it is in the best interests of the City of Newark to accept this gift on behalf of the City; and

 

WHEREAS, The Home Depot, Store 0908, 399-443 Springfield Avenue, Newark, New Jersey 07103, requires the City to issue a Certificate of Self-Insurance and Hold Harmless Agreement before performing the work; and

 

WHEREAS, the Newark Municipal Council indicates its support of the rehabilitation of B-28 in City Hall by supporting the issuance of a Hold Harmless and Indemnification Agreement for the benefit of The Home Depot, Store 0908; and

 

WHEREAS, pursuant to Local Public Contracts Law (N.J.S.A.40A:5-29), a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNCIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of Engineering, are authorized to accept the gift of materials and labor for the rehabilitation of Room B-28 in City Hall from The Home Depot, Store 0908, 399-443 Springfield Avenue, Newark, New Jersey 07103, as sponsored through the Italian American War Veterans of the United States to the City of Newark.

 

2.                     No municipal funds will be expended for the acceptance of this gift.

 

3.                     The Municipal Council supports the issuance of a Hold Harmless and Indemnification Agreement drawn by the City of Newark Insurance Fund Commission, for the benefit of The Home Depot, Store 0980, 399-443 Springfield Avenue, Newark, New Jersey 07103, for claims arising out of the work to be performed by the Home Depot volunteers for the rehabilitation of City Hall Room B-28.

 

4.                     The City Clerk shall forward a copy of the Hold Harmless and Indemnification Agreement to The Home Depot, Store 0980, 399-443 Springfield Avenue, Newark, New Jersey 07103, for their records. 

 

5.                     The Home Depot, Store 0908 and the Italian American War Veterans of the United States, assert that they expect nothing in return for the gift to the City of Newark other than the Hold Harmless and Indemnification Agreement (a copy of the letters are attached).

 

6.                     A copy of the Hold Harmless and Indemnification Agreement drawn by the Insurance Fund Commission shall be filed with the Office of the City Clerk. 

  

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Director of Engineering, to accept a gift of materials and labor from the Home Depot, Store 0908, 399-443 Springfield Avenue, Newark, New Jersey 07103, as sponsored by Italian American War Veterans of the United States, for the rehabilitation of Room B-28 in City Hall through their Team Depot program, valued at ten thousand six hundred three dollars and eighty-seven cents ($10,603.87), and further supports the issuance of a Hold Harmless and Indemnification Agreement drawn by the City of Newark Insurance Fund Commission. No municipal funds will be expended.
