WHEREAS, pursuant to Resolution 7R1A(S), authorized on January 11, 2011, the City of Newark appropriated $200,000.00 in Community Development Block Grant (CDBG) funds to The Trust for Public Land, One Washington Street, Suite 1401-H, Newark, NJ 07102, (hereinafter referred to as the Sub-recipient) to provide physical rehabilitation services to the Jessie Allen Park Project (the Park) located within the Central Ward of the City of Newark; and
WHEREAS, pursuant to Resolution 7R1-g, authorized on June 15, 2011, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute contract with the sub-recipient for the purpose of performing physical rehabilitation, for the contract period January 1, 2011 - December 31, 2011, in an amount not to exceed $200,000.00; and
WHEREAS, the Sub-recipient has requested authorization to increase the contract amount by One Million Seventeen Thousand Dollars ($1,017,000.00) for continued public facilities development/rehabilitation services to the Park; and
WHEREAS, the Sub-recipient also seeks authorization from the Municipal Council to extend the contract period from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012 to complete the scope contained within the First Amended Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Agreement, in the form attached hereto, with The Trust for Public Land, One Washington Street, Suite 1401-H, Newark, NJ 07102, (hereafter referred to as the Sub-recipient), to extend the term of the contract from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012 increase the contract amount by $1,017,000.00 for a total contract amount of $1,217,000.00, and to amend the Scope of Services, to allow the sub-recipient to complete the public facilities development/ rehabilitation services to Jessie Allen Park, located within the Central Ward, City of Newark.
- The First Amended Agreement between the City of Newark and the sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
- This resolution and a fully executed copy of the First Amended Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
- All other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R1-g 061511 shall remain in full effect and in accordance with the law.
- Attached hereto is a copy of the certification of funds from the Comptroller of the City of Newark, which states that there are sufficient legally appropriated funds in the amount of $1,017,000.00 for the purpose here-in-above set forth. The certification shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development. 6. Attached hereto and made a part of the First Amended Agreement is the amended Scope of Services for Jesse Allen Park Phase II and III.

Resolution ratifying and authorizing the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a First Amended Agreement, in the form attached hereto, with The Trust For Public Land, One Washington Street, Suite 1401-H, Newark, NJ 07102, to extend the term of the contract from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012 ,increase the contract amount by $1,017,000.00 for a total contract amount of $1,217,000.00 and to amend the Scope of Services, to allow the sub-recipient to complete the public facilities development/ rehabilitation services to Jessie Allen Park located within the Central Ward of the City of Newark, NJ.
