WHEREAS, pursuant to Resolution 7R1-h, authorized on September 8, 2011, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a CDBG Sub-recipient Agreement with International Youth Organization, Inc. (hereafter referred to as the "Sub-recipient") for the purpose of performing public facilities development/rehabilitation to its facility located at 703 South 12th Street, Newark, NJ 07103, Block 2619, Lot 38 (South Ward), for the term of January 1, 2011 - December 31, 2011, for an amount not to exceed $180,000.00; and
WHEREAS, the Sub-recipient has requested authorization to extend the term of the CDBG Sub-recipient Agreement from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012 to complete the above development/rehabilitation; and
WHEREAS, this project does not require the use of additional funds and all other terms and conditions contained in contract authorized under Resolution 7R1-h 090811 shall remain in full effect.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Sub-recipient Agreement, in the form attached hereto, with the International Youth Organization, Inc., (hereafter referred to as the "Sub-recipient") to amend the term of the Sub-recipient Agreement from January 1, 2011-December 31, 2011 to January 1, 2011-December 31, 2012, to allow the sub-recipient to complete the public facilities development/ rehabilitation to its facility located at 703 South 12th Street, Newark, NJ 07103, Block 2619, Lot 38 (South Ward).
2. The First Amended Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
3. This resolution and a fully executed copy of the First Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
4. This project does not require the use of additional funds and all other terms and conditions contained in the CDBG Sub-recipient Agreement authorized pursuant to Resolution 7R1-h 090811 shall remain in full effect and in accordance with the law.
