This Resolution authorizes the use of Morris County Cooperative Pricing Council Contracts to purchase various goods and services for various City Departments and agencies through December 2024.

                       WHEREAS, on January 18, 2023, pursuant to N.J.S.A. 40A:11-11(5), the City of Newark's (“City’s”) Governing Body adopted Resolution 7R1-C authorizing the City’s membership in the Morris County Cooperative Pricing Council of New Jersey, 502 Millbrook Avenue, Randolph, New Jersey 07869 (“MCCPC”); and

 

WHEREAS, the MCCPC, a locally recognized and accepted cooperative purchasing organization maintains local cooperative contracts, which are competitively awarded and through which its members can make cost-effective purchases; and

 

WHEREAS, the MCCPC system was fueled by the desire of government agencies to save taxpayer dollars by pooling purchasing power to receive discounted prices on a wide range of goods and services; and

 

WHEREAS, the City, through its Qualified Purchasing Agent, wishes to utilize the MCCPC contracts to purchase various goods and services to be used by the several City departments and agencies; and 

 

WHEREAS, each department or agency will be required to present a certification of funds signed by the Chief Financial Officer or an approved purchase order to complete each purchase, which purchase shall be subject to the terms and conditions of the applicable MCCPC contract; and

 

WHEREAS, the relevant MCCPC Notifications of Award of various  contracts and their respective contractual terms are attached hereto.

 

               

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designees the Business Administrator, and/or the Purchasing Agent are authorized to enter into contracts with various authorized Morris County Cooperative Pricing Council (“MCCPC”) vendors for the purchase of goods and services, on an as-needed basis, subject to the terms and conditions applicable to their respective MCCPC contracts.

 

2.                     The total amount expended for purchases pursuant to this Resolution shall not exceed Two Hundred Thousand Dollars and Zero Cents ($200,000.00). The term of the authorization granted hereunder shall commence on the date of this authorizing Resolution and terminate on December 31, 2024, or, for any particular good or service, on the termination date of the applicable MCCPC contract, whichever occurs first.

 

3.                     All purchases, purchase orders, and any other ancillary documentation shall accord with the relevant MCCPC contract, including Standard Terms and Conditions, Methods of Operation, and  third-party agreements, if applicable, as contained in the MCCPC contract documentation and agreements.

 

4.                     There shall be no amendments to this Resolution without the approval of the Municipal Council.

 

5.                     This Resolution authorizes open-ended contracts to be used by various City of Newark departments and agencies as needed upon authorization through December 2024. Thus for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.AC. 5:30-5.5(d)(2), shall be executed before any contractual liability is incurred each time an order is placed, covering the amount of the order. All departments/offices and applicable funding sources will be presented with the certification of funds signed by the Chief Financial Officer or an approved purchase order on an as-needed basis.

 

6.                     A copy of the contract with the purchase documents shall be filed with the Office of the City Clerk with a copy of this authorizing Resolution.

 

7.                     No additional Governing Body action is necessary to authorize the aforementioned purchases of City goods and services from MCCPC.

 

 

 

 

STATEMENT

 

This Resolution authorizes the Mayor of the City of Newark and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent, to purchase goods and services, as needed, for various City Departments and agencies under the Morris County Cooperative Pricing Council (“MCCPC”) contracts.
