WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $6,028,700.00 for the COPS Hiring Program and no adequate provision has been made in the 2012 temporary budget for the aforesaid purpose and N.J.S.A 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned; and
 
WHEREAS, by award letter dated September 28, 2011 from the United States Department of Justice, Office of Community Oriented Policing Services, the City was awarded $6,028,700.00 to fund the rehiring of 25 Newark Police Officers; and
 
WHEREAS, the City of Newark is responsible to fund an amount not to exceed $3,180,475.00 over the 3-year grant period including  the additional 12 month retention period in 2015 required by the terms of the grant; and
 
WHEREAS, in the first year of the grant, the City's financial responsibility  is provided for in the 2012 Newark Police Department's Budget under the category of Salary and Wages; and
 
      
      WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
 
WHEREAS, the emergency appropriations adopted in 2012 pursuant to N.J.S.A. 40A:4-20 including this resolution total $94,713,388.00.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      An emergency appropriation is and the same is hereby made for the following classification:

2.      Said emergency appropriation shall be provided for in the 2012 budget.
 
3.      A copy of this resolution shall be immediately filed with the City Clerk by the Budget Director of the City of Newark.
 
 
STATEMENT
 
This Legislation establishes the appropriation in the amount of $6,028,700.00 for the 2011 COPS HIRING PROGRAM (CHP) funded by the United States Department of Justice, Office of Community Policing Services to fund the rehiring of 25 Newark Police Officers.  The grant period is September 1, 2011-August 31, 2014 and a twelve (12) month retention period at the end  of the grant period.
