WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provides funds for Local Safety Programs; and

WHEREAS, on September 19, 2014, the City of Newark, Department of Engineering, submitted an FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study to the North Jersey Transportation Planning Authority (NJTPA) requesting grant funding in the amount of $350,415.00 (includes Federal Funding of $280,332.00 + Local In-Kind Match of $70,083.00); and

WHEREAS, as a result of this request, the City of Newark was notified on July 1, 2015 by the North Jersey Transportation Planning Authority (NJTPA) that the City of Newark is authorized to incur costs for the FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study, in the amount of $350,000.00 (which includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00); and

WHEREAS, the City of Newark desires to enter into a "sub-contract" between the City of Newark (Sub Contractor) and the North Jersey Transportation Planning Authority Inc. (NJTPA), for the amount of $350,000.00 (which includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00), to be used for FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study; and

WHEREAS, upon final authorization of this project from NJTPA, the Director of the Department of Engineering shall submit a copy of the authorization letter and the grant/project agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit a FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study in the amount of $350,000.00 which includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00); FY 2013 Local Safety Program to the North Jersey Transportation Planning Authority (NJTPA).

2. The Municipal Council hereby ratifies its authorization of this FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study, in the amount of $350,000.00 (which includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00), from the date of submission to the date of adoption of this authorizing resolution.

3. The grant award in the amount of $350,000.00 (includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00) is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

4. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the North Jersey Transportation Planning Authority (NJTPA) to receive and expend the grant award in the amount of $350,000.00 (which includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00) for FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study.

5. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.

6. The Director of Engineering shall file a fully-executed copy of the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.

STATEMENT

This resolution ratifies and authorizes the actions taken by the City of Newark, Department of Engineering, to submit the FY 2016-2017 Unified Planning Work Program (UPWP) Subregional Studies Program project entitled Newark Downtown Circulation Improvement Study to the North Jersey Transportation Planning Authority (NJTPA) requesting grant funding, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amount of $350,000.00 ( which includes Federal Funding of $280,000.00 + Local In-Kind Match of $70,000.00) from the North Jersey Transportation Planning Authority (NJTPA).
