WHEREAS, Resolution 7R2-b adopted on October 2, 2019 by the Municipal Council authorized the Mayor to accept the following Workforce Innovation Opportunity Act (WIOA) allotments: WIOA - Youth ($2,135,842.00), WIOA - Adult ($2,014,659.00), WIOA - Dislocated Worker ($771,481.00); totaling $4,921,982.00 through the Newark Workforce Development Board (NWDB) grant funds for Program Year 2019 (July 1, 2019 through June 30, 2020) with eighty percent (80%) obligated by June 30, 2020 and fully expended by June 30, 2021; and
WHEREAS, there exists a need for NewarkWORKS to enter into a contract with an entity that can provide twenty (20) WIOA-Adult clients for heating, ventilation and air conditioning (HVAC) training pursuant to the provisions of WIOA Program Year 2019; and
WHEREAS, on April 15, 2019, NewarkWORKS advertised a Request for Proposal (RFP), returnable on June 21, 2019, for training services under the provisions of WIOA Program Year 2019; and
WHEREAS, on June 21, 2019, NewarkWORKS received a total of twenty-one (21) proposals for both WIOA Youth and Adult which were opened on the same day and entered on a tabulation bid sheet, (a copy of which is attached); and
WHEREAS, the Selection Committee reviewed the proposal received from National Career Institute, 134 Evergreen Place, East Orange, New Jersey 07018, which was approved by (NWDB) and was found to be one of the most advantageous to the City of Newark based upon price, experience and all other criteria listed in the RFP; and
WHEREAS, NewarkWORKS wishes to enter into a one (1) year contract with National Career Institute to provide heating, ventilation and air conditioning (HVAC) training pursuant to the WIOA for twenty (20) WIOA-Adult clients for an amount not to exceed Eighty Thousand Dollars and Zero Cents ($80,000.00), for Program Year 2019; and
WHEREAS, the contract is subject to availability of funds from the United States Department of Labor, Employment and Training Administration, Workforce Innovation and Opportunity Act of 2014 through the New Jersey Department of Labor and Workforce Development, with eighty percent (80%) obligated by June 30, 2020 and fully expended by June 30, 2021 or returned to the State; and
WHEREAS, this contract is being awarded pursuant to State and Local Public Contracts Law, including N.J.S.A. 40A: 11-4.1(b)(2), N.J.S.A. 40A:11.5 and/or as educational services to N.J.S.A. 40A: 11-5(1) (q) (as applicable), and the Work First New Jersey (WFNJ); and
WHEREAS, this contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5; and
WHEREAS, the Municipal Council adopted the Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, which forbids the award of a contract to a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidate committees of the aforementioned candidates; and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of the City of Newark municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor, Deputy Mayor for Workforce Development and Director of Newark One Stop Career Center/NewarkWORKS are authorized to enter into and execute a one (1) year contract with National Career Institute, 134 Evergreen Place, East Orange, New Jersey 07018, to provide heating, ventilation and air conditioning (HVAC) training to twenty (20) WIOA-Adult clients for Program Year 2019. The contract commences on July 1, 2019 and terminates on June 30, 2020, for an amount not to exceed Eighty Thousand Dollars and Zero Cents ($80,000.00). The term of the contract will be established for one (1) year.
2. This contract between the City of Newark and National Career Institute is hereby ratified from July 1, 2019 to the date of adoption of this authorizing resolution.
3. Attached hereto is Certification of Funds from the Director of Finance of the City of Newark, which states (1) that there are sufficient funds, in the amount of Eighty Thousand Dollars and Zero Cents ($80,000.00), for purpose set forth here in above and (2) that the line appropriation of the official budget which shall be charged is Business Unit NW051, Dept. G19, Div./Proj. M19N0, Account # 72060, Budget Ref: B2019.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
5. There shall be no amendment or changes to this contract without approval of the Municipal Council.
6. The Director of NewarkWORKS shall file forth with a copy of the fully executed contract with the Office of the City Clerk and shall be made available for public inspection.

This resolution ratifies and authorizes the Mayor and/or his designees, the Deputy Mayor for Workforce Development and Director of Newark One Stop Career Center/NewarkWORKS, to enter into and execute a contract, with National Career Institute, 134 Evergreen Place, East Orange, New Jersey 07018, pursuant to the provisions of WIOA-Adult allotments, to provide heating, ventilation and air conditioning (HVAC) training to twenty (20) WIOA-Adult clients, for a total amount not to exceed Eighty Thousand Dollars and Zero Cents ($80,000.00), for a period of July 1, 2019 through June 30, 2020.
