Original Resolution 7R5-b adopted on February 5, 2020, awarded a contract in an amount not to exceed $1,153,136.00 for the period of January 1, 2020 through December 31, 2020.

 

This resolution will increase the contract amount by $70,610.00 for a total contract amount not to exceed $1,223,746.00 extending the period through July 30, 2023 for additional services to prevent, prepare for, and respond to coronavirus.

WHEREAS, through Resolution 7R5-b adopted on February 5, 2020, the City of Newark authorized an award of a contract to Newark Beth Israel Medical Center, as a Sub-Recipient of HOPWA grant funding for the period of January 1, 2020 through December 31, 2020, to provide certain housing assistance and supportive services to persons with HIV/AIDS for an amount not to exceed One Million, One Hundred Fifty-Three Thousand, One Hundred Six Dollars and Zero Cents ($1,153,136.00); and

 

                     WHEREAS, on March 27, 2020, to assist communities in their efforts to prevent, prepare for and respond to the Coronavirus Pandemic (COVID-19), the Federal Coronavirus Aid, Relief and Economic Security (CARES) Act was signed into law and included supplemental formula allocations to HUD’s Community Planning and Development programs, with allocations of $4,310,416.00 in CDBG funds, $7,621,389.00 in ESG, and $842,513.00 in HOPWA funds for the City of Newark; and

 

                      WHEREAS, the CARES Act provides additional funds specifically for addressing COVID-19 related impact and expense of services from July 31, 2020 through July 30, 2023; and

 

                     WHEREAS, this contract allocates supplemental funds provided under the CARES Act to HOPWA grantees as additional funding to maintain operations, and for rental assistance, supportive services, and other necessary actions, to prevent, prepare for, and respond to coronavirus for persons living with HIV/AIDS through sub-recipient contracts within the Newark Eligible Metropolitan Statistical Area (NEMSA), which consists of Essex, Hunterdon, Morris, Somerset, Sussex, and Union Counties in New Jersey and Pike County, Pennsylvania; and

 

                     WHEREAS, the City of Newark desires to continue to act as the Grantee/Sub-Grantor for disbursement of funds made available by the United States Department of Housing and Urban Development (HUD), Housing Opportunities for Persons with AIDS (HOPWA) Program, CARES ACT, to prevent, prepare for, and respond to coronavirus for persons living with HIV/AIDS through sub-recipient contracts within the Newark Eligible Metropolitan Statistical Area (NEMSA), which consists of Essex, Hunterdon, Morris, Somerset, Sussex, and Union Counties in New Jersey and Pike County, Pennsylvania; and

 

WHEREAS, Newark Beth Israel Medical Center is a Sub-Recipient of the HOPWA grant funding and therefore is eligible to receive supplemental funds under the CARES Act; and

 

WHEREAS, as more fully set forth in the scope of services (attached hereto) the City seeks to provide short term rental assistance to current HOPWA recipients provided for through the CARES ACT additional funds; and

 

WHEREAS, the term of the contract is amended and ratified back to July 31, 2020, with allowable recoupment of COVID related expenses stemming from January  21, 2020; and

 

                     WHEREAS, the CARES Act supplemental funds may be used to cover or reimburse allowable costs as of the date a sub-recipient began preparing for coronavirus, which HUD shall presume to be no earlier than January 21, 2020; and

 

WHEREAS, an increase in the amount $70,610.00 to the current Contract is necessary to prevent, prepare for, and respond to the coronavirus pandemic; and

 

WHEREAS, the $1,153,136.00 of HOPWA funds from the underlying grant agreement must be used by December 2020 and the $70,610.00 CARES Act funding for supplemental COVID 19 related expenses awarded under this agreement must be expended by July 30, 2023; and

 

WHEREAS, the Department of Health and Community Wellness seeks to ratify and amend the contract to increase the amount previously approved in order to meet the increase to address the coronavirus pandemic; and 

 

WHEREAS, the City of Newark, is in receipt of a request from the Department of Health and Community Wellness to increase the not to exceed amount from $1,153,136.00 to $1,223,746.00.

 

 

         NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Department of Health and Community Wellness, is hereby authorized to ratify and amend Resolution 7R5-b adopted on February 5, 2020 for a contract with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112, to provide certain housing assistance and supportive services to persons with HIV/AIDS and to prevent, prepare for, and respond to the coronavirus pandemic by increasing the contract amount from $1,153,136.00 to $1,223,746.00.  

 

2.                     The contract amendment is ratified from July 31, 2020, through the date of adoption of this authorizing resolution and s specific to the HOPWA COVID-19 funds increase of $70,610.00.

 

3.                     Attached here is a Certification of Funds in the amount of $70,610.00, from the Municipal Comptroller of the City of Newark, which states that there are sufficient funds in the City budget for the purpose set forth herein. 2020 Budgets/Department of Health and Community Wellness/ NW 051; Dept. 4.                     The services to be provided pursuant to the original HOPWA grant award of $1,153,136.00 terminates December 30, 2020.  The supplemental grant award of $70,610.00 under the CARES Act funding for COVID 19 related expenses awarded under this agreement must be expended by July 30, 2023, thereby extending the  terms and conditions of the contract authorized by Resolution 7R5-b adopted on February 5, 2020, but solely as to the supplemental funding.

 

 

STATEMENT

 

This resolution authorizes the Department of Health and Community Wellness to ratify and amend Resolution 7R5-b adopted on February 5, 2020 for a contract with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112, utilizing HOPWA funding, to provide housing assistance and supportive services to persons with HIV/AIDS, and to prevent, prepare for, and respond to the coronavirus pandemic within the Newark Eligible Metropolitan Statistical Area, by increasing the total contract amount from $1,153,136.00 to $1,223,746.00. The supplemental grant award of $70,610.00, under the CARES Act funding for COVID 19 related expenses awarded under this agreement must be expended by July 30, 2023, thereby extending the  terms and conditions of the contract authorized by Resolution 7R5-b adopted on February 5, 2020, but solely as to the supplemental funding.
