WHEREAS, the Newark Municipal Council desires to support the Annual a Children's Halloween Parade and Festivities at Branch Brook Park - Visitor’s Center (between Heller Parkway and Mill Street), Newark, New Jersey 07107 (if inclement weather, festivities will take place at Flamboyan Manor (inside), 147 Verona Avenue, Newark, New Jersey 07104), sponsored by Council Member, Luis A. Quintana and Council Member, Anibal Ramos, Jr., on Tuesday, October 31, 2017, from 11:00 A.M. until 8:00 P.M. (Event: 3:00 P.M. until 8:00 P.M.); and
WHEREAS, the Newark Municipal Council has indicated its support for this wholesome event for the benefit of Newark residents by supporting the issuance of two Hold Harmless and Indemnification Agreements by the City of Newark Insurance Fund Commission for the benefit of Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, and if inclement weather, for the benefit of Flamboyan Manor (inside), 147 Verona Avenue, Newark, New Jersey 07104.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission for the benefit of Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, for any claims arising out of the City of Newark’s use of Branch Brook Park - Visitor’s Center (between Heller Parkway and Mill Street), Newark, New Jersey 07104 and, in the event of inclement weather for the benefit of Flamboyan Manor, 147 Verona Avenue, Newark, New Jersey 07104 for any claims arising out of the City of Newark’s use of the inside of Flamboyan Manor for the Annual Children’s Halloween Parade and Festivities on Sunday, October 31, 2017, from 11:00 A.M. until 8:00 P.M. (Event: 3:00 P.M. until 8:00 P.M.).
2. The City Clerk, on behalf of the Newark Municipal Council, shall forward a true copy of the Hold Harmless and Indemnification Agreement to the Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104 and, if required due to change of venue as the result of inclement weather to Flamboyan Manor, 147 Verona Avenue, Newark, New Jersey 07104, for their records.
3. A copy of the executed Hold Harmless and Indemnification Agreement, drawn by the Insurance Fund Commission, shall be filed in the Office of the City Clerk.
STATEMENT
This resolution hereby supports the issuance, by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement for the benefit of the Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104 for any claims arising out of the City of Newark’s use of Branch Brook Park - Visitor’s Center (between Heller Parkway and Mill Street), Newark, New Jersey 07104 and if required due to change of venue as the result of inclement weather, for the benefit of Flamboyan Manor, 147 Verona Avenue, Newark, New Jersey 07104 for any claims arising out of the City of Newark’s use of the inside of Flamboyan Manor, for the Annual Children's Halloween Parade and Festivities on Sunday, October 31, 2017, from 11:00 A.M. until 8:00 P.M. (Event: 3:00 P.M. until 8:00 P.M.) sponsored by Councilman Luis A. Quintana and Councilman Anibal Ramos, Jr.
