Resolution 7R2-e(AS) adopted on February 22, 2019, authorized the acceptance of bids and execution of Quitclaim Deeds for the properties sold at public auction on January 24, 2019.

WHEREAS, Resolution 7R2-d (AS) adopted on December 19, 2018 by the Municipal Council, authorized the sale of City-owned properties, no longer needed for public use, by open public sale at an auction to the highest bidder, pursuant to N.J.S.A. 40A:12-13(a) on January 24, 2019; and

WHEREAS, Alonzo Herran, 470 Mount Prospect Avenue, Unit 1, Newark, New Jersey 07104, successfully placed a bid on the property located at 32-34 Tillinghast Street, Newark, New Jersey 07108, located on the City's Official Map as Block 3029, Lot 11, in the amount of One Hundred Fifty-Five Thousand Dollars and Zero Cents ($155,000.00), which is referenced in Exhibit A of Resolution 7R2-e(AS) adopted on February 22, 2019; and

WHEREAS, after the adoption of Resolution 7R2-e(AS) on February 22, 2019, Alonzo Herran requested that the name associated with his bid be amended to that of a limited liability company solely owned by him, 32-34 Tillinghast, LLC; and

WHEREAS, this resolution seeks to amend Exhibit A of Resolution 7R2-e (AS) adopted on February 22, 2019, which lists the properties authorized to be sold at the public auction and includes the successful bidder's names, addresses, purchase price and deposits, more specifically the name of the bidder for the property located at 32-34 Tillinghast Street, Newark, New Jersey, 07108, Block 3029, Lot 11, shall be changed from Alonzo Herran to 32-34 Tillinghast, LLC; and

WHEREAS, the City of Newark desires to amend Resolution 7R2-e(AS) adopted on February 22, 2019 and authorize the sale of properties listed on the attached Amended Exhibit A, by open public auction on January 24, 2019, pursuant to the conditions enumerated in Exhibit B, attached hereto and made a part hereof.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The City of Newark hereby amends Exhibit A of Resolution 7R2-e (AS) adopted on February 22, 2019 by the Municipal Council, and authorizes the amendment of the name associated with Alonzo Herran's bid during an open public sale at an auction conducted on January 24, 2019, from Alonzo Herran to 32-34 Tillinghast, LLC, as reflected on the Amended Exhibit A, attached hereto and made a part hereof.

2. The City of Newark hereby amends the name associated with Alonzo Herran's bid from Alonzo Herran to 32-34 Tillinghast, LLC, which auction was authorized by Resolution 7R2-e (AS) adopted on February 22, 2019, and is hereby ratified .

3. All other terms and conditions of the original Resolution 7R2-e(AS), adopted on February 22, 2019, including Exhibit B, attached hereto and made a part hereof, are hereby ratified and confirmed and shall remain in full force.

4. The Department of Economic and Housing Development shall publish the aforesaid Amended Exhibit A and Exhibit B in the manner provided for in N.J.S.A. 40A:12-13(a), along with the description of the properties, the terms and conditions aforesaid and the submission of an affidavit of publication to the Office of the City Clerk for filing.


STATEMENT

This resolution amends Resolution 7R2-e (AS) adopted on February 22, 2019, and authorizes the amendment of Alonzo Herran's bid name from Alonzo Herran to 32-34 Tillinghast, LLC.
