WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of One Hundred Seventy-Seven Thousand Seven Hundred Sixty-Five Dollars and Fifty Cents ($177,765.50) to provide financial assistance to conduct remediation activities on the property located at 200 16th Avenue and 204-214 16th Avenue for the Proposed Youth Center and no adequate provision has been made in the 2023 Temporary Budget for the aforesaid purpose and N.J.S.A. 40:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by resolution 7R2-q dated April 19, 2023, The City of Newark accepted the Proposed Youth Center-HDSRF, in the amount of $177,765.50 from the New Jersey Economic Development Authority (NJEDA); and
WHEREAS, N.J.S.A 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, the emergency appropriation adopted in 2023 pursuant to N.J.S.A. 40A:4-20 including this resolution total is $ 320,715,455.97.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. An emergency appropriation be and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2023 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This resolution establishes the temporary emergency appropriation for One Hundred Seventy-Seven Thousand Seven Hundred Sixty-Five Dollars and Fifty Cents ($177,765.50) for the property located at 200 16th Avenue and 204-214 16th Avenue for the Proposed Youth Center - HDSRF. Funding has been provided by the New Jersey Economic Development Authority (NJEDA). The grant period is the date the grant is disbursed from NJEDA and will expire five (5) years after disbursement.
