Resolution 7R12-b adopted on August 6 2025, awarded a contract in an amount not to exceed $12,700,000.00 for a period of 365 calendar days from the date of the written Notice to Proceed to final completion.
Change Order #1 will increase the contract period by 32 days for a new contract period of 397 days from the date of the written Notice to Proceed.

WHEREAS, 7R12-b adopted on August 6, 2025, authorized the Director of the Department of Water and Sewer Utilities to execute Contract 18-WS2025 Rebid, Expansion of Filtration Building and Construction of Additional Filters 12 and 4 at the Pequannock Water Treatment Plant, with Pact Two LLC (“Pact Two”), 554 Route 31, Ringoes, New Jersey 08551, in the amount of $12,700,000.00 for a period of 365 calendar days from the date of the written Notice to Proceed, in accordance with the Local Public Contracts Law, N.J.S.A. 4A:11-1 et seq: and
WHEREAS, due to lead-times associated with procurement of the butterfly valves impacting the critical path of the project, a non-compensatory time extension increase of 32 calendar days has been requested. See breakdown and recommendations in attached Contractor Change Order request; and
WHEREAS, pursuant to N.J.A.C. 5:30-11 et eq. Contract No. 05-WS2024 is to be amended to include an increase in the contract period by Thirty-two (32) calendar days for a new contract period of Three Hundred Ninety-Seven (397) calendar days from the date of the written Notice to Proceed to final completion.
WHEREAS, the Department of Water and Sewer Utilities wishes to enter into and execute a Contract Change Order #1 to Contract 18-WS2025 Rebid, Expansion of Filtration Building and Construction of Additional Filters 12 and 4 at the Pequannock Water Treatment Plant, with Pact Two LLC (“Pact Two”), for a contract amount not to exceed of Twelve Million, Seven Hundred Thousand Dollars and Zero Cents ($12,700,000.00) and a time increase of Thirty-Two calendar days for a new contract period of Three Hundred and Ninety-Seven (397) calendar days from the date of the written Notice to Proceed until final completion.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Contract change order #1 to Contract 18-WS2025 Rebid, Expansion of Filtration Building and Construction of Additional Filters 12 and 4 at the Pequannock Water Treatment Plant, with Pact Two LLC (“Pact Two”), 554 Route 31, Ringoes, New Jersey 08551, for a contract amount not to exceed of Twelve Million, Seven Hundred Thousand Dollars and Zero Cents ($12,700,000.00) and a time increase of Thirty-Two calendar days for a new contract period of Three Hundred and Ninety-Seven (397) calendar days from the date of the written Notice to Proceed until final completion.
2. No Funds are required for this Change Order #1.
3. A fully executed copy of the Change Order #1 shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities.
4. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 5 2:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution amends and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into and execute Contract Change Order #1 to Contract 18-WS2026 (Re-Bid), the Expansion of Filtration Building and Construction of Additional Filters 12 and 4 at the Pequannock Water Treatment Plant, with Pact Two LLC, 429, 554 Route 31, Ringoes, New Jersey 08551, increasing the contract period by 32 days for a total contract period of 397 calendar days from the date of the written Notice to Proceed until final completion.
