WHEREAS, pursuant to the “Special Law Enforcement Officers Act”, (N.J.S.A. 40A:14-146.8, et seq., as amended and supplemented) (“SLEOA”) the New Jersey State Legislature has established uniform procedures for the appointment of Special Law Enforcement Officers throughout the State; and        

 

                        WHEREAS, these procedures require the Director of Public Safety to verify the eligibility and qualifications of all Newark Special Police Officer appointees and to report such determination in writing to the Municipal Council; and

 

WHEREAS, the Chief of Police has certified to the Director of Public Safety that  the Special Police Officer (“SPO”) listed in Appendix A  meets all SLEO requirements, including U.S. citizenship, New Jersey residency, proficiency in English, a high school diploma or equivalent, sound mental and physical health, good moral character, and successful completion of psychological testing and firearms training; and

 

WHEREAS, the Director of Public Safety has approved the listed SPO; and

 

                             WHEREAS, the Special Police Organization of New Jersey shall maintain insurance coverage acceptable to the City at and pay any deductibles, attorney’s fees and expenses arising from litigation being filed against the SPO; and 

 

                             WHEREAS, the Chief of Police may recommend decommissioning of the SPO to the Director of Public Safety if insurance premiums or deductibles are not timely paid; and

 

                            WHEREAS, the Corporation Counsel recommends that the Special Police Organization of New Jersey execute an Indemnification and Hold Harmless Agreement in favor of the City to ensure coverage above the policy limits; and

 

WHEREAS, the Director of Public Safety has mandated that all SPOs volunteer twenty (20) hours per year at Special Events for economic efficiencies.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The named individual listed in Appendix A of the Certification of the Chief of Police is hereby appointed as a Class Two Special Police Officer (“SPO”) for the term commencing on September 19, 2025 and ending on December 31, 2025.

 

2.                     The appointed SPO shall be subject to the provisions of the SLEOA,  applicable City ordinances,  and rules and regulations promulgated by the Director of Public Safety or Chief of Police.

 

3.                     The Municipal Council supports the Director of Public Safety’s mandate that all SPOs volunteer twenty (20) hours per year to assist with coverage at Special Events. 

 

4.                     In the event that insurance premiums or applicable deductible are not timely paid by the SPO, the Chief of Police may recommend decommissioning to the Director of Public Safety.

 

5.                     The Special Police Organization of New Jersey must ensure coverage for the SPO beyond the policy limits, and is responsible for any deductibles prior to the insurance coverage;, the City shall not be responsible.

 

6.                     The Office of the Director of Public Safety shall verify the address provided by the SPO  via certified, return receipt mail, and inform the Municipal Council of any undelivered letters. The appointment may be revoked for providing an incorrect address or failing to update the address.

 

7.                     The resolution is ratified from September 19, 2025, to the adoption date of this resolution.

 

8.                     The Office of the Director of Public Safety shall file an executed copy of this resolution with the Office of the City Clerk.

 

STATEMENT

 

This resolution ratifies and authorizes the appointment of one (1) non-resident as a Class Two Special Police Officer for a term commencing September 19, 2025 and ending on December 31, 2025. It supports the Director of Public Safety’s mandate that the SPO volunteer twenty (20) hours per year for coverage at Special Events.
