WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
WHEREAS, the City of Newark has been awarded a Green Acres grants totaling $2,600,000 and an Urban Parks grant of $500,000 from the State to fund the following project(s): 0714-21-011 0714-21-UPG Broadway Park; and
WHEREAS, the State and the City of Newark intend to increase Green Acres funding by $1,400,000, to increase Green Acres funding to a total of $4,000,000
WHEREAS, the City wishes to accept grant funding through the State for the development of Broadway Park, in the estimated amount of One Million Four Hundred Thousand Dollars and Zero Cents ($1,400,000.00); and
WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, Urban Parks Grant and notify the City of the amount of the funding award; and
WHEREAS, the City will use the State’s funds in accordance with applicable rules, regulations and statutes, and is willing to enter into an agreement with the State for the above-named project; and
WHEREAS, upon notification of the receipt of the grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of the grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services shall submit a copy of the grant agreement to the Corporation Counsel and Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of Recreation, Cultural Affairs and Senior Services is hereby authorized to execute an agreement and any amendment(s) thereto with the State known as Broadway Park, and;
2. The applicant agrees to provide its matching share to the Green Acres funding, if a match is required, in the amount of $2,860,000.00, and;
3. The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project, and;
4. This resolution shall take effect immediately.
5. The Director of the Department of Recreation, Cultural Affairs and Senior Services shall file a fully executed copy of any grant/project agreement authorized by this Resolution in the Office of the City Clerk
STATEMENT
This Resolution authorizes the actions taken by the Mayor of the City of Newark and/or his designee and the Director of the Department of Recreation, Cultural Affairs and Senior Services to submit an application for grant funding from the New Jersey Department of Environmental Protection, Green Acres Program (“State”) and further authorizes the Mayor of the City of Newark and/or his designee and the Director of the Department of Recreation, Cultural Affairs and Senior Services for acceptance of grant funds from the State, by entering into and executing the Green Acres Project Agreement in connection therewith.
