EXECUTIVE ORDER ESTABLISHING A TEMPORARY PUBLIC SAFETY CURFEW WITHIN THE VICINITY OF DELANEY HALL DETENTION CENTER, MAY 31, 2026

Body

WHEREAS, the City of Newark is committed to protecting the health, safety, and welfare of all residents, visitors, businesses, first responders, and individuals lawfully present within the City; and

WHEREAS, recent events occurring in the vicinity of Delaney Hall Detention Center have resulted in conditions that pose an increased risk to public safety, including reports of fires being set, roadway obstructions, and activities that may impede the ability of emergency personnel to respond to emergencies and protect persons and property; and

WHEREAS, the City has a compelling interest in ensuring that police, fire, emergency medical services, and other public safety personnel are able to safely access and operate within affected areas without obstruction or interference; and

WHEREAS, the City recognizes and respects the constitutional rights of individuals to engage in lawful speech, assembly, and peaceful protest, while also maintaining its responsibility to preserve public safety and order; and

WHEREAS, a temporary                      is necessary to reduce the likelihood of further dangerous conditions during overnight hours, protect the public, preserve access for emergency responders, and safeguard public and private property;

NOW, THEREFORE, BE IT ORDERED BY RAS J. BARAKA, MAYOR OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     Establishment of Temporary Curfew Area

 

A temporary public safety curfew is hereby established within a one-half (h) mile radius of I)elaney Hall Detention Center, located at:

Delaney Hall Detention Center

451 Doremus Avenue

Newark, New Jersey 07105

 

2.                     Curfew Hours

 

a.                      Effective immediately beginning at 12:00 a.m. on May 31, 2026, a curfew shall be in effect within the designated curfew area from 12:00 a.m. until 6:00 a.m.

b.                      Beginning on the evening of May 31, 2026, and continuing each day thereafter until further notice, the curfew shall be in effect from 9:00 p.m. until 6:00 a.m.

 

3.                     Applicability

 

During curfew hours, no person shall remain, loiter, congregate, or travel within the designated curfew area except as otherwise permitted by this Order.

 

4.                     Exemptions

 

The tbllowing i_ndividuals and activities shall be exempt from the curfew:

 

a.                     Law enforcement officers, firefighters, emergency medical personnel, and other public safety officials acting within the scope of their duties;

b.                     Government employees, utility workers, contractors, and other individuals performing authorized governmental, emergency, or essential services:

c.                     Residents living within the designated curfew area traveling for essential purposes; and

d.                     Any other person specifically authorized by law enforcement or emergency management officials.

e.                     Credentialed members of the news media who are engaged in newsgathering, reporting, broadcasting, photographing, recording, or other legitimate joumalistic activities, provided they do not interfere with law enforcement, emergency operations, or public safety activities.

 

5.                     Enforcement

 

The Newark Police Division, in coordination with other authorized public safety agencies, shall take all reasonable and necessary measures to enforce this Order and maintain public safety within the designated curfew area.

 

6.                     Duration

 

This Executive Order shall remain in effect until modified, rescinded, or superseded by subsequent Executive Order.

 

7.                     Severability

 

If any provision of this Executive Order is determined to be invalid by a court of competent jurisdiction, such determination shall not affect the remaining provisions, which shall remain in full force and effect.

 

8.                     Effective Date

 

This Executive Order shall take effect immediately.
