WHEREAS, on behalf of the City of Newark, the Public Safety Director submitted an application to the United States Department of Justice - Bureau of Justice Assistance, requesting funding in the amount of $395,879.00 from the FY2021 Edward Byrne Memorial Justice Grant Local Program, to fund police overtime initiatives to address violent crime with no City funds required (“Application”); and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
WHEREAS, the City of Newark has received notification of receipt of the grant award in connection with the Application, and the Public Safety Director desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, the City of Newark has received notification of receipt of the grant award in connection with this application, and the Public Safety Director is submitting a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature; and
WHEREAS, the City of Newark, as largest of the Essex County Municipalities, shall be the lead applicant and shall be responsible for administration of the funds including distribution of the funds, monitoring the award, submitting progress reports and providing ongoing assistance to sub-recipients of the funds; and
WHEREAS, the Police Division has been awarded grant funding in the amount of $395,879.00 from the FY2021 Edward Byrne Memorial Justice Assistance Grant Local Program to be distributed among several municipalities within Essex County New Jersey for the purpose of implementing strategies to prevent and control crime with no City funds required; and
WHEREAS, a Memorandum of Understanding among the participating municipalities, represented by their respective law enforcement Executive, has allocated funding pursuant to the following schedule: Newark = $265,395.00, Irvington = $45,068.00, East Orange = $45,151.00, Orange = $27,609.00, Essex County Sheriff = $12,656.00; and
WHEREAS, the City of Newark desires to fund police overtime initiatives to address violent crime.
NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to enter into a Memorandum of Understanding with the participating sub-recipients of Essex County New Jersey, Irvington Police Department, East Orange Police Department, Orange Police Department, and Essex County Sheriff, and submit an application to the United States Department of Justice, Bureau of Justice Assistance, requesting grant funding in the amount of $395,879.00 from the 2021 Edward Byrne Memorial Justice Assistance Grant Local Program, for the purpose of implementing strategies to prevent and control crime with no City funds required (“Application”), which is attached hereto and made a part hereof.
2. The Municipal Council hereby ratifies its authorization of the submission of the Application and the Memorandum of Understanding from the date of submission of the Application and the Memorandum of Understanding to the date of adoption of this authorizing Resolution.
3. The Grant Award in the amount of $395,879.00, from the United States Department of Justice, Bureau of Justice Assistance, is hereby accepted.
4. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to enter into and execute such grant documents and agreements with the United States Department of Justice, as may be necessary to receive and expend the grant funds for the purpose of implementing strategies to prevent and control crime.
5. The Municipal Council hereby ratifies its authorization of the execution of the grant documents and agreements from the date of execution to the date of adoption of this Resolution.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Public Safety Director shall file a fully executed copy of the FY2021 Edward Byrne Memorial Justice Assistance Grant Local Program Application, the Grant Award Letter, Memorandum of Understanding, and the Grant Agreement in the Office of the City Clerk together with this Resolution.
STATEMENT
This Resolution ratifies and authorizes the Mayor and/or his designee, the Public Safety Director, to submit an application for, accept, and enter into an agreement for the FY2021 Edward Byrne Memorial Justice Assistance Grant Local Program for funding in the amount of $395,879.00 from the United States Department of Justice for the purpose of implementing strategies to prevent and control crime. No municipal funds are required.
