WHEREAS, N.J.S.A. 54:5-19.1 authorizes Electronic Tax Sales pursuant to rules and regulations to be promulgated by the Director of the Division of Local Government Services, (hereinafter referred to as “the Division”); and
WHEREAS, the Director of the Division has promulgated rules and regulations for pilot programs; and
WHEREAS, the Director of the Division has approved R.O.K Industries, d/b/a NJTaxlieninvestor.com, and Realauction.com LLC, to conduct an Electronic Tax Sales pilot program; and
WHEREAS, ROK Industries is utilizing RealAuction.com, LLC.’s Approved Auction Platform that it may market and conduct electronic auctions of Tax Certificates under the Electronic Tax Sale Pilot Program on behalf of the City of Newark; and
WHEREAS, on August 2, 2017, the City of Newark adopted Resolution 7R4-b for participation in the pilot program for an Electronic Tax Sale; and
WHEREAS, an Electronic Tax Sale is an online, innovative, efficient means of generating a greater pool of potential lien buyers, thus creating the environment for a more complete and thorough tax sale process; and
WHEREAS, the City of Newark received provisional approval from the Division on August 15,2017 to participate in the Electronic Tax Sale Pilot Program and the City is required to submit the signed contract between the City and R.O.K Industries, Inc. d/b/a NJ Tax Lien Investors (R.O.K. Industries) and RealAuction.com LLC. (RealAuction) within 30 days before the first advertisement or first tax sale notice; and
WHEREAS, the Director of Finance wishes to enter into a new contract with R.O.K Industries and RealAuction, to provide Electronic Tax Sale services in an amount of $15.00 per property, listed on the initial list of properties to be provided by the City of Newark to R.O.K Industries, for an amount not to exceed One Hundred Forty-Nine Thousand Sixty-One Dollars and Twelve Cents ($149, 061.12), for a period of one (1) year from the date of final contract execution with an option to renew; and
WHEREAS, R.O.K Industries, Inc., is the sole vendor approved by the Division of Local Government Services to offer such online tax sale services hence foregoing any requirement to solicit bids.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Finance, are authorized on behalf of the City of Newark to enter into a contract with R.O.K Industries, d/b/a NJ Tax Lien Investor (R.O.K Industries), utilizing RealAuction.com LLC. (RealAuction) Approved Auction Platform, 306 Harlingen Road, Belle Mead, New Jersey 08502, for a period of one year from the date of final contract execution, for an amount of $15.00 per property, listed on the initial list of properties provided by the City of Newark to R.O.K Industries, for a total amount not to exceed One Hundred Forty-Nine Thousand Sixty-One Dollars and Twelve Cents ($149,061.12).
2. Attached hereto is a Certification of Funds from the Director of Finance which states that funds in the amount of $149,061.12 are available in the 2017 Budget, Business Unit NW011, Dept. 050, Div./Proj. 0505, Account # 71050, Budget Ref. B2017. The Director of Finance/CFO shall file the Certification, the original resolution, and the executed contract in the Office of the City Clerk.
3. This contract is awarded without competitive bidding as R.O.K Industries, is the sole vendor, approved by the Division of Local Government Services, to offer online tax sale services therefore foregoing any requirement to solicit bids. Certified copies of the fully executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Finance/Chief Financial Officer of the City of Newark.
4. This contract will be for a term of one (1) year from the date of final contract execution with the option to renew the contract for one (1) year, with Municipal Council approval, as may be consistent with the term of the State’s pilot program.
5. A notice of the award of the contract shall be published in the newspaper authorized by law within ten (10) days of the adoption of this resolution.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department Finance to enter into a contract between the City of Newark with R.O.K Industries, Inc. d/b/a NJ Tax Lien Investor utilizing RealAuction.com LLC.’s Approved Auction Platform , 306 Harlingen Road, Belle Mead, New Jersey 08502 to provide online Electronic Tax Sales for an amount not to exceed One Hundred Forty-Nine Thousand Sixty-One Dollars and Twelve Cents ($149, 061.12) for a term of one (1) year from the date of final contract execution with an option to renew for one (1) year as may be consistent with the term of the State’s pilot program.
