WHEREAS, on December 11, 2017, the Director of the Department of Health and Community Wellness requested an emergency declaration to provide shelter services to at risk individuals; and

 

WHEREAS, on December 12, 2017, the Supervising Procurement Specialist, QPA, declared an emergency for the provision of shelter services to at risk individuals; and

 

WHEREAS, on or about December 12, 2017, the Department of Health and Community Wellness entered into Emergency Contract E-2017-25 to provide shelter to at risk individuals at 224-238 Sussex Avenue, Newark, New Jersey 07103, by 689 South 16th Street Corp., alternate name Emergency Housing Services, 555 Passaic Avenue, West Caldwell, New Jersey 07006 (a copy of said Emergency Contract E-2017-25 is attached hereto and made a part hereof); and

WHEREAS, on March 29, 2018, the Department of Health and Community Wellness amended Emergency Contract E-2017-25, by increasing the contract amount from $333,000.00 to $533,000.00, due to the harsh cold temperatures increasing the number of at risk individuals seeking shelter; and

    

WHEREAS, one of the primary functions of the Department of Health and Community Wellness is to assist those individuals at risk and provide emergency shelter during inclement weather and further avail the at risk individuals to a variety of essential social services and referrals for medical, dental, and mental health services so the at risk individual may begin the journey to self-sustainability; and

 

WHEREAS, the Department of Health and Community Wellness is in immediate and emergent need to further provide shelter to those at risk individuals so that case management services may continue for the period of March 14, 2018 through June 30,2018; and

 

WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and

                     

WHEREAS, City Ordinance 6PSF-e, adopted April 6, 2011, Article 2:5-13.2(e)(1)(c) provides that no extension of an emergency contract shall be permitted without authorization by the Municipal Council by resolution; and

 

WHEREAS, the Department of Health and Community Wellness desires to extend the amended Emergency Contract E-2017-25 for the period of March 14, 2018 through June 30,2018, in an amount not to exceed $585,000.00 to continue to provide case management and emergency sheltering; and

 

WHEREAS, N.J.A.C. 5:30:5-5(a) provides that municipalities may enter into contracts without a full Certification of Funds when the municipality is operating under a temporary budget, and the City of Newark is, in fact, currently operating under a temporary budget.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director for the Department of Health and Community Wellness, are authorized to extend amended Emergency Contract E-2017-25 with 689 S. 16th Street Corp. alternate name Emergency Housing Services, 555 Passaic Avenue, West Caldwell, New Jersey 07006, at 224-238 Sussex Avenue, Newark, New Jersey  for the period of March 14, 2018 through June 30,2018, in an amount not to exceed $585,000.00 to continue to provide emergency sheltering services  and case management services.

 

2.                     Attached hereto is a partial Certification of Funds in the amount of $363,000.00 from the Municipal Comptroller of the City of Newark, indicating that there are sufficient funds available for all liability to be incurred during the City of Newark’s temporary budget period, more specifically, Partial Certification of Funds in the amount of $363,000.00, Fund 011, Department 120, Division/Project 1205, Account# 71280, Budget Ref 2018. The balance of funds in the amount of $222,000.00 shall be certified from the budget line as follows; 027-A15-EC5EO-2015 in the amount of $75,423.00; 027-A17-EC7EO-2016 in the amount of $100,000.00; and 027-A18-EC815-2018 in the amount of $46,577.00

 

 

3.                     The Supervising Procurement Specialist, QPA, for the City of Newark shall file a copy of the amended Emergency Contract E-2017-25 with the Office of the City Clerk.

 

4.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008. 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee(s), the Supervising Procurement Specialist, QPA, and/or the Director for the Department of Health and Community Wellness, to extend amended Emergency Contract E-2017-25 with 689 South 16th Corp., alternate name, Emergency Housing Services, 555 Passaic Avenue, West Caldwell, New Jersey 07006, for the provision of emergency sheltering services and continued case management, for the period of March 14, 2018, through June 30,2018, in an amount not to exceed $585,000.00.
