WHEREAS, the State of New Jersey Department of Transportation (“NJDOT") FY-2024 Bikeway Grant Program for Bike-2024 provides Municipalities with grant funding for bicycle lane projects; and
WHEREAS, on July 1, 2023, the Acting Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the NJDOT FY-2024 Bikeway Grant Program for construction of the Newark Morris Canal Bikeway Phase 2 Project, identified as BIKE-2024 Newark Morris Canal Bikeway Phase 2 (the “Project”); and
WHEREAS, on July 11, 2023, the Municipal Council adopted Resolution 7R3-b ratifying and authorizing the Acting Director of the Department of Engineering to apply for, accept, and execute grant documents for a grant award from the NJDOT FY-2024 Bikeway Grant Program for construction of the Project; and
WHEREAS, on November 29, 2023 NJDOT announced that the City was selected to receive a grant award in the amount of Seven Hundred Sixty-Nine Thousand Dollars and Zero Cents ($769,000.00) for the construction of the Project; and
WHEREAS, NJDOT requires the City to award the contract for construction of the Project within two (2) years of the grant award notification, which is November 28, 2025;
WHEREAS, due to the need for additional design and coordination of utility infrastructure, the award of such contract has been delayed; and
WHEREAS, the City wishes to submit a request that the NJDOT extend this deadline until May 28, 2026 to allow the City additional time to award the contract for construction of the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to request a time extension from the State of New Jersey Department of Transportation (“NJDOT”) which would allow the City of Newark until May 29, 2026 to award a contract for construction of BIKE-2024 Newark Morris Canal Bikeway Phase 2 Project (“Project”).
2. The Mayor of the City of Newark and/or his designee, the Acting Director of Engineering, are hereby further authorized to execute any document necessary to effectuate any extension accorded by NJDOT.
3. All other terms and conditions of the grant award from the NJDOT for the FY-2024 Bikeway Program for Bike-2024 Newark Morris Canal Bikeway Phase 2 Project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering to request a time extension from NJDOT to allow the City of Newark additional time to award a contract for construction of the BIKE-2024 Newark Morris Canal Bikeway project Phase 2, thereby extending the deadline from November 28, 2025 through May 28, 2026. No municipal funds are required.
