      WHEREAS, pursuant to Resolution 7R1-A(S), authorized on January 11, 2011, the City of Newark appropriated $71,600.00 in Community Development Block Grant (CDBG) funds to Clinton Hill Community and Early Childhood Center, Inc., (hereinafter referred to as the Sub-recipient) to provide Public Facilities Development/Rehabilitation to its facility located at 420 Hawthorne Avenue, Newark, New Jersey 07112, Block 3621, Lot 12/South Ward (the "Project"); and
 
WHEREAS, pursuant to Resolution 7R1-C, authorized on October 5, 2011, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a Sub-recipient Agreement with the Sub-recipient for the purpose of completing the Project, for the period January 1, 2011 through December 31, 2011, in an amount not to exceed $71,600.00; and
 
WHEREAS, the Sub-recipient has requested authorization to extend the agreement period to complete the Project from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012; and
 
 
WHEREAS, the Project does not require the use of additional funds and all other terms and conditions contained in the Sub-recipient Agreement authorized under Resolution 7R1-C 100511 shall remain in full effect.  
            
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Sub-recipient Agreement in the form attached hereto with Clinton Hill Community and Early Childhood Center, Inc., (hereafter referred to as the Sub-recipient) which will amend the term of the Sub-recipient Agreement from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012, to allow the Sub-recipient to complete the Public Facilities Development/Rehabilitation to  its facility located at 420 Hawthorne Avenue, Newark, New Jersey  07112, Block 3621, Lot 12/South Ward (the "Project").
 
2.      The First Amended Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
 
3.      This resolution and a fully executed copy of the First Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
 
4.      The project does not require the use of additional funds and all other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R1-C 100511 shall remain in full effect and in accordance with the law.
 
 
STATEMENT
 
This resolution hereby ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a First Amended Sub-recipient Agreement, in the form attached hereto, with Clinton Hill Community and Early Childhood Center, Inc., to amend the term of the Sub-recipient Agreement from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012 and to allow the Sub-recipient to complete the Public Facilities Development/Rehabilitation to its facility located 420 Hawthorne Avenue, Newark, New Jersey, 07112, Block 3621, Lot 12/South Ward.
