Original Resolution 7R3-a adopted on September 18, 2024 authorized Contract No. 2024-02PS for a contract amount not to exceed $265,355.13 for a period of 365 consecutive calendar days from the issuance of the formal notice-to-proceed date of February 03, 2025. This amendment extends the period for contract completion by one (1) year or until completion of construction/project close out.

WHEREAS, on September 18, 2024, the Municipal Council adopted Resolution 7R3-a, which authorized the Mayor and/or his designee, the Acting Director of the Department of Engineering, to enter into and execute Contract 2024-02PS with Colliers Engineering and Design, Inc., 101 Crawfords Corner Road, Suite 3400, Holmdel, New Jersey 07733 (“Colliers Engineering”), for the provision of construction management and inspection services for the Newark Ironbound Roundabout Project (“Project”), for a contract period of 365 consecutive calendar days from the date of the formal Notice to Proceed and for the total not-to-exceed contract amount of Two Hundred Sixty-Five Thousand Three Hundred Fifty-Five Dollars and Thirteen Cents ($265,355.13); and
WHEREAS, on January 29, 2025, the Department of Engineering issued a Notice to Proceed (“NTP”) for Contract 2024-02PS to Colliers Engineering specifying a NTP date as of February 03, 2025; and
WHEREAS, by letter dated November 24, 2025, the general contractor, Berto Construction, Inc., informed Colliers Engineering of the substantial completion of the construction of the Project; and
WHEREAS, inspection of the substantially completed project identified several items requiring correction, resulting in Colliers Engineering’s issuance on December 29, 2025 of a punch list outlining the items that needed to be addressed); and
WHEREAS, on March 17, 2026 the Department of Engineering - Division of Traffic and Signals (“Division”) notified the New Jersey Department of Transportation (“NJDOT”) of the substantial completion of the Project and indicated that the Project was ready for final inspection; and
WHEREAS, NJDOT conducted a final inspection on March 23, 2026 and identified some items in the project that needed the following corrective work:
1. Repair the damaged concrete curb along the east side of both Backus Street & Wheeler Point Road. Please refer to photos 1 & 2.
2. Repair all sidwalk and curb cracking between Wheeler Point Road and Denbigh Street with a cement adhesive material. Please refer to photos 3, 4 & 5.
3. Repair the sidwalk cracking and the water ponding across from 94 Elm Road. Please refer to photos 6 & 7.
4. Provide the proper landscaping improvements along the west side of Chestnut Street. Please refer to photo No. 8.
5. The roof drain leaders located at the following three properties are draining onto the sidewalk, causing a potential hazard during the winter season for pedestrians. Please refer to photos 9, 10, & 11.

• 92 Elm Road, Newark, NJ 07105; and
WHEREAS, pursuant to a letter to the Division dated May 05, 2026, Colliers Engineering informed the City that, due to the results of NJDOT’s final inspection, it would need an additional time to perform Contract 2024-02PS; and
WHEREAS, on June 11, 2026, the Assistant Director of the Department of Engineering issued a memo to the City’s Business Administrator requesting an extension of time of 365 calendar days or until completion of construction/project close out; and
WHEREAS, the Acting Director of Engineering desires to amend the contract period of Contract No. 2024-02PS to allow adequate time to close out the Project; and
WHEREAS, such amendment does not increase the contract price.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to enter into and execute an amendment to Contract 2024-02PS (“Change Order #1”) with Colliers Engineering and Design, Inc., 101 Crawfords Corner Road, Suite 3400, Holmdel, New Jersey 07733 extending the contract period three hundred sixty-five (365) calendar days or until completion of construction/project close out.
2. All other terms and conditions of Contract 2024-02PS Newark Ironbound Roundabout Safety Improvements Project shall remain the same and in effect until the contract is completed.
3. The authority to enter into and execute Change Order # 1 is ratified back from February 3, 2026 until the date of adoption of this authorizing resolution.
4. No further amendments or modifications to Contract 2024-02PS shall be permitted without prior Municipal Council approval.
5. The Acting Director of Engineering shall cause a fully executed copy of Change Order #1/Amendment to Contract 2024-02PS Newark Ironbound Roundabout Safety Improvements Project to be filed in the Office of the City Clerk.
6. No additional municipal funds are necessary in connection with this Resolution.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Acting Director of the Department of Engineering to enter into and execute an amendment to Contract 2024-02PS (“Change Order #1”) with Colliers Engineering and Design, Inc., 101 Crawfords Corner Road, Suite 3400, Holmdel, New Jersey 07733, to extend the time to complete/finalize the Newark Ironbound Roundabout Safety Improvements Project by three hundred sixty-five (365) calendar days or until completion of construction/project close out. The authority granted is pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-15(9) and N.J.A.C. 5:30-11.1 et seq.
