      WHEREAS, the Department of Fire continues its efforts to ensure the protection of critical port infrastructure from terrorism; by enhancing maritime domain awareness, training and exercises and capabilities to prevent, detect, respond to and recover from attacks involving improvised explosive devices and other non-conventional weapons; and
 
WHEREAS, the United States Department of Homeland Security, Federal Emergency Management Agency (FEMA) through The Port Authority of NY & NJ has implemented the FY2008 Port Security Grant Program, Port of New York/New Jersey for eligible municipalities that provide security protection to federally regulated facilities; and
 
WHEREAS, on behalf of the City of Newark, the Director of the Department of Fire submitted an application to the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ, 241 Erie Street, Room 202, Jersey City, New Jersey 07310, requesting grant funding in the amount of $56,250.00, to aid in our continuous efforts of protecting critical port infrastructure from terrorism; and
 
WHEREAS, as a result of this application, the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ awarded the City of Newark, $56,250.00 requiring a 25% matching expenditure of $18,750.00 by the City, for the procurement of a MAC SIC Quick Response Vehicle, which will expand the response capabilities to the North Jersey Port Region; and
 
WHEREAS, the total budget is $75,000.00 to purchase the MAC SIC Quick Response Vehicle is as follows: and
 
(A)      $56,250.00 from the United States Department of Homeland
                  Security and FEMA
(B)      $18,750.00 (25%) City of Newark Cash Match
$75,000.00
 
WHEREAS, the City of Newark Department of Fire desires to accept funds in the amount of $56,250.00; and
 
WHEREAS, the City of Newark wishes to agree to any amendments to the Grant.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee and the Director of Fire are hereby authorized to submit an application to the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ requesting funding in the amount of $56,250.00 for the purchase of a MAC SIC Quick Response Vehicle with a 25% City Cash Match in the amount of $18,750.00 (a copy of the application is attached hereto and made a part thereof).
 
2.      The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
 
3.      The grant award in the amount of $56,250.00 from the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ under the FY2008 Port Security Grant Program is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
 
4.      Matching Funds in the amount of $18,750.00 shall be provided from the following line appropriation of the Official 2012 Municipal Budget:  Fund Code 026, Department 090, Division 0901, Source Code 46300.
 
5.      The Mayor and/or his designee, the Director of the Department of Fire, are hereby authorized to enter into and execute grant documents with the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ  to receive and expend the grant award in the amount of $56,250.00, for the purchase of a MAC SIC Quick Attack Response Vehicle, for the period commencing June 10, 2010 and terminating on September 30, 2012 (a copy of grant award letter is attached hereto and made a part hereof).
 
6.      The agreement between the City of Newark and the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ  is  hereby ratified from June 10, 2010 to the date of adoption of this authorizing resolution.
 
7.      The Director of the Department of Fire shall file a fully executed copy of the grant application and notice of grant award in the Office of the City Clerk.
 
 
STATEMENT
 
This Resolution ratifies and authorizes the actions taken by the Director of the Department of Fire to submit an application for grant funding from the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ for the purchase of purchase of a MAC SIC Quick Attack Response Vehicle, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Fire to enter into and accept grant funds in the amount of $56,250.00 from the United States Department of Homeland Security, Federal Emergency Management Agency through The Port Authority of NY & NJ for the protection of critical port infrastructure from terrorism for the period commencing on June 10, 2010 and terminating September 30, 2012.  Matching grant funds in the amount of $18,750.00 shall be provided from the 2012 municipal budget.
