WHEREAS, on September 9, 2025, the City of Newark through its Purchasing Agent, QPA, advertised to solicit bids for contractors to provide Laboratory Services: Lead Analysis, Dust Wipes for the Department of Health and Community Wellness/Division of Environmental Health, as described in the attached bid proposal; and
WHEREAS, on September 25, 2025, the Division of Central Purchasing received Three (3) bids; (1) Batta Environmental Associates, Inc., 6 Garfield Way, Newark, DE 19713; (2) Bay Hill Labs, 2060 Fairfax Avenue, Cherry Hill, New Jersey 08003 and (3) Ger-cor painting & contracting co., 57 South Main Street, Unit 169, Neptune, New Jersey 07753; and
WHEREAS, the bid tabulations were shared with the Director of the Department of the Department of Health and Community Wellness (“DHCW”) who recommended that all bids be rejected due to required substantial revisions to the bid specifications to address additional needs of the lead program; and
WHEREAS, on October 16, 2025, the City of Newark through its Qualified Purchasing Agent, QPA, advertised to solicit bids for contractors to provide Laboratory Services: Lead Analysis, Dust Wipes for the Department of Health and Community Wellness, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing also published the bid package on the City’s website to provide a broader access; and download capability to potential bidders; and
WHEREAS, on October 28, 2025, the Division of Central Purchasing received Five (5) bids; (1) Batta Environmental Associates, Inc., 6 Garfield Way, Newark, Delaware, 19713; (2) Bay Hill Labs, Inc., 2060 Fairfax Avenue, Cherry Hill, New Jersey 08003 and (3) Ger-cor painting & contracting co., 57 South Main Street, Unit 169, Neptune, New Jersey 07753; (4) Pledge Environmental LLC., 648 Newark Avenue, Elizabeth, New Jersey, 07208, (5) Lab Street LLC., 915 Montgomery Avenue, Suite 110, Narberth, Pennsylvania, 19004 and
WHEREAS, the Director of the DHCW”) after reviewing the bid results, recommended that all bids be rejected due to required substantial revisions to the bid specifications to address additional needs of the lead program; and
WHEREAS, the bid from Ger-cor Painting & Contracting was deemed non-responsive, due to lack of submittal of the mandatory Statement of Ownership Disclosure Form signature page which is a fatal defect; and
WHEREAS, On November 3, 2025, the Director of the Department of Health and Community Wellness recommended that a multiple awards be made to: (a) Batta Environmental Associates, Inc., 6 Garfield Way, Newark, Delaware, 19713; (b) Bay Hill Labs, Inc., 2060 Fairfax Avenue, Cherry Hill, New Jersey 08003; (c) Pledge Environmental LLC., 648 Newark Avenue, Elizabeth, New Jersey, 07208, and (d) Lab Street LLC., 915 Montgomery Avenue, Suite 110, Narberth, Pennsylvania, 19004 and which they deemed the lowest responsive bidders per line-item commodities; and
WHEREAS, after a review of the bids received and the recommendation from the Director of the DHCW, the Purchasing Agent, QPA concurs with their recommendation to award to the responsible bidders, as requested, in the following manner:
a. Batta Environmental Associates, Inc., 6 Garfield Way, Newark, Delaware, 19713, line items 2, 3, 6 and 7 for both years one (1) and two (2); and
b. Bay Hill Labs, Inc., 2060 Fairfax Avenue, Cherry Hill, New Jersey 08003, line items 4 and 9 for both years one (1) and two (2); and
c. Lab Street LLC., 915 Montgomery Avenue, Suite 110, Narberth, Pennsylvania, 19004, line items 1, 5 and 10 for year one (1) and line items 1, 5, 9 and 10 year two (2); and
d. Pledge Environmental LLC, 648 Newark Avenue, Elizabeth, New Jersey 07208, line item 8 for both years one (1) and two (2); and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the recommended bidders consented to holding their prices bid for consideration, until such time as an award is made, as the law permits; and
WHEREAS, pursuant to N.J.S.A. 19:44A20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meet the requirements of the Fair and Open Process
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and /or his designee, the Business Administrator and the Purchasing Agent, QPA are hereby authorized to enter into and execute contracts with; (a) Batta Environmental Associates, Inc., 6 Garfield Way, Newark, Delaware, 19713, line items 2, 3, 6 and 7 for both years one (1) and two (2); (b)Bay Hill Labs, Inc., 2060 Fairfax Avenue, Cherry Hill, New Jersey 08003, line items 4 and 9 for both years one (1) and two (2); (c) Lab Street LLC., 915 Montgomery Avenue, Suite 110, Narberth, Pennsylvania, 19004, line items 1, 5 and 10 for year one (1) and line items 1, 5, 9 and 10 year two (2); (d) Pledge Environmental LLC, 648 Newark Avenue, Elizabeth, New Jersey 07208, line item 8 for both years one (1) and two (2), as the lowest responsive and responsible vendors per line items commodity to provide Laboratory Services: Lead Analysis, Dust Wipes to the City Department of Department Health and Community Wellness/Division of Environmental Health at a cost not to exceed One Hundred Ten Thousand Dollars and Zero Cents ($110,000.00).
2. There shall be no amendment or change of this Resolution without the approval of the Municipal Council by resolution.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
4. The Qualified Purchasing Agent, QPA shall file a duly executed copy of the contract in the Office of the City Clerk, if applicable.
5. If required by State Law, the Acting City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated July 1, 2025.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Business Administrator, and the Purchasing Agent, QPA to enter into and execute contracts with (a) Batta Environmental Associates, Inc., 6 Garfield Way, Newark, Delaware, 19713; (b) Bay Hill Labs, Inc., 2060 Fairfax Avenue, Cherry Hill, New Jersey 08003; (c) Pledge Environmental LLC., 648 Newark Avenue, Elizabeth, New Jersey, 07208, and (d) Lab Street LLC., 915 Montgomery Avenue, Suite 110, Narberth, Pennsylvania, 19004 to provide Laboratory Services: Lead Analysis, Dust Wipes for the City Department of Department Health and Community Wellness/Division of Environmental Health for a total contract amount not to exceed One Hundred Ten Thousand Dollars and Zero Cents ($110,000.00), for a period of twenty-four (24) consecutive months, commencing upon a fully executed contract.
