New Jersey Institute of Technology (NJIT), 323 Dr. Martin Luther King, Jr., Blvd., Newark, New Jersey 07102 would like to donate five (5) custom-built seating cabanas to the City of Newark to be placed at selected outdoor pools (Bo Porter, Boylan, Hayes West, and Rotunda) which will enhance the aesthetics and pool experience for the residents of the City of Newark. The custom-built seating cabanas have a value of One Hundred Fifty Thousand Dollars ($150,000.00).

WHEREAS, New Jersey Institute of Technology (NJIT), 323 Dr. Martin Luther King, Jr. Blvd., Newark, New Jersey 07102 would like to donate five (5) custom-built seating cabanas to the City of Newark (“City”) to be placed at selected outdoor pools (Bo Porter, Boylan, Hayes West, and Rotunda) in the City, which will enhance the aesthetics and the pool experience for the residents of the City of Newark.
WHEREAS, said donation will encompass the design, construction, and delivery of said cabanas; and
WHEREAS, the custom cabanas have a value of One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00); and
WHEREAS, the Director of the Department of Recreation, Cultural Affairs & Senior Services (“Department”) desires to accept the gift of the custom-built seating cabanas and acknowledge the donation; and
WHEREAS, NJIT fully understands that it is not entitled to receive any direct benefit from the City of Newark, Mayor Ras J. Baraka, or any other personnel affiliated with the City in exchange for the gift; and
WHEREAS, pursuant to N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift from the New Jersey Institute of Technology, 323 Dr. Martin Luther King, Jr., Blvd., Newark, New Jersey 07102 of five (5) custom-built seating cabanas to be placed at selected outdoor pools (Bo Porter, Boylan, Hayes West, and Rotunda) in the City of Newark.
2. This gift is valued at One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00.)
3. The City acknowledges the generous donation of the five (5) custom built seating cabanas through this Resolution.
4. No municipal funds will be expended for the acceptance of this gift.
