WHEREAS, Newark Housing Authority (“NHA”), a public body politic and corporate, manages a federally funded portfolio of public housing units for low and very-low income families in the City of Newark (“the City”); and
WHEREAS, the City provides temporary emergency shelter and other supportive services to certain homeless families through a program known as the City of Newark’s Emergency Assistance program ("EAP"); and
WHEREAS, NHA and the City has negotiated an Agreement, and other necessary documents, to make not less than two hundred (200) units (hereinafter "Path Home Units" or “PHU”) available to house persons who qualify under the Path Home Program (“PHP”) and who are eligible for public housing in accordance with the NHA' s Admission and Continued Occupancy Plan (“ACOP"), as it may be amended from time to time (the “Agreement”); and
WHEREAS, the City will implement the Path Home Program, with the assistance of NHA, as requested by the NHA; and
WHEREAS, the City will provide a list of eligible homeless applicants that qualify for public housing under the PHP to receive the PHU who will complete the necessary applications for the PHP; and
WHEREAS, in accordance with the Agreement, the NHA will accept not less than two hundred (200) residents from the PHP Referral List who qualify for housing under the ACOP ("Eligible Path Home Applicant") for participation in this public housing program; and
WHEREAS, the City will fund the rehabilitation of the Path Home Units and provide the stabilization services to Path Home Program participants through its Providers, subject to the availability of funding from the City and through municipal bonding; and
WHEREAS, in accordance with the Shared Services Act, the City seeks to enter into the attached Shared Services Agreement to share expertise and resources with NHA to provide the housing units and services for the mutual benefit of the families to be served; and
WHEREAS, the City and NHA desire to expedite the rehabilitation of up to 200 housing units by entering into the Agreement attached, and to collaborate on the Path Home Program, which collaboration is anticipated to include a contributions by the City of up to Two Hundred Fifty Thousand Dollars an Zero Cents ($250,000.00) directly, and up to Six Million Dollars and Zero Cents ($6,000,000.00) municipal bond funding subject to the City’s eligibility for and receipt of such municipal bond funding; and
WHEREAS, in order to expedite the rehabilitation of the housing units and provide homes for eligible families the Path Home Program will be funded in four phases, beginning with Phase 1 for the rehabilitation of up to 15 housing units utilizing City funds of up to Two Hundred Fifty Thousand Dollars and Zero Cents ($250,000.00) directly payable by the City to NHA in accordance with the attached Agreement.
NOW THEREFORE BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK THAT:
1. The Mayor of the City of Newark is hereby authorized to execute the attached Agreement with the Newark Housing Authority (“NHA”), as well as all documents necessary.
2. To expedite the rehabilitation of the housing units and provide homes for eligible families, the Path Home Program will be funded in four phases, beginning with Phase 1 for the rehabilitation of up to 15 housing units utilizing City funds of up to Two Hundred Fifty Thousand Dollars and Zero Cents ($250,000.00) directly payable by the City to NHA in accordance with the attached Agreement; and
3. Subject to the Agreement, the City will make not less than a total of two hundred (200) units (hereinafter "Path Home Units" or “PHU”) available to persons who qualify under the Path Home Program (“PHP”) in accordance with the NHA' s Admission and Continued Occupancy Plan (“ACOP"), and to provide those qualified persons with services through the City’s Providers; and
4. The City will seek up to Six Million Dollars and Zero Cents ($6,000.000.00) municipal bond funding for the rehabilitation of the Path to Home Program Units, subject to the applicable law, eligibility and requirements.
5. It is anticipated that the cost of the Agreement to implement the Path Home Program will not exceed Six Million Dollars and Zero Cents ($6,000,000.00).
6. It is anticipated that except for the Two Hundred Fifty Thousand Dollars and Zero Cents ($250,000.00) in City funds, the funds necessary to implement this program will be derived from the City’s municipal bond funding subject to the eligibility for and availability of those funds.
STATEMENT
This Resolution authorizes the Mayor to execute the attached Agreement with the Newark Housing Authority and to seek up to Six Million Dollars and Zero Cents ($6,000.000.00) in municipal bond funding for the rehabilitation of the Path to Home Program Housing Units to be provided by the Newark Housing Authority, subject to the applicable law, eligibility and requirements. It is anticipated that except for the Two Hundred Fifty Thousand Dollars and Zero Cents ($250,000.00) in City funds, the funds necessary to implement this program will be derived from the City’s municipal bonds.
