WHEREAS, the City of Newark (“City”) desires to invest its budget and resources to support stormwater planning and analysis; and
WHEREAS, on August 1, 2024, on behalf of the City, the Director of the Department of Water and Sewer submitted an application to the New Jersey Department of Environmental Protection (NJDEP) requesting grant funding for the implementation of stormwater utility that would include developing a stormwater rate ordinance, credits and appeals program, stormwater data management tools, storm utility business process, and overall project implementation (“Application”); and
WHEREAS, on November 29, 2024, as a result of the application, the City entered into a grant agreement with NJDEP to receive grant funding to support stormwater planning and analysis (“Project”) in the amount of One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00) (“Initial Grant Award”); and
WHEREAS, the Project required the City to provide an in-kind match of the Initial Grant Award in the amount of One Hundred Forty-Three Thousand Dollars and Zero Cents ($143,000.00); and
WHEREAS, on April 1, 2026, the City requested to amend the Application to modify the Project budget and match structure to reflect a refined and more targeted scope of work that consists of performing impervious area data development services; and
WHEREAS, on August 17, 2026, NJDEP approved the City’s revision to the scope of work and reduced the City’s grant award from One Hundred Fifty Thousand Dollars and Zero Cents ($150,000.00) to Fifty-One Thousand Nine Hundred Fifty-Eight Dollars and Zero Cents ($51,958.00) (“Grant Funds”); and
WHEREAS, the grant award requires the City provide and in-kind match of the Grant Funds in the amount of Forty-Nine Thousand Five Hundred Forty-Three Dollars and Forty-Four Cents ($49,543.44).
WHEREAS, the City desires to accept said Grant Funds; and
WHEREAS, NJDEP requires that the Municipal Council pass a Resolution authorizing the Application and acceptance of Grant Funds to be submitted with the grant agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Business Administrator, and the Director of the Department of Water and Sewer, are hereby authorized to apply for, and accept grant funding from the New Jersey Department of Environmental Protection (NJDEP), 501 E. State Street, Trenton, NJ 08625, in the amount of Fifty-One Thousand Nine Hundred and Eighty Dollars and Zero Cents ($51,980.00) (“Grant Funds”) to perform impervious area data development services.
2. The Mayor of the City of Newark and/or his designee, the Business Administrator, and the Director of the Department of Water and Sewer, are further authorized to execute a grant agreement or any other document necessary to receive the Grant Funds and to receive and expend the Grant Funds pursuant to the terms of the Grant Agreement.
3. The Municipal Council hereby ratifies its authorization of the application for, and its acceptance of, this grant award, any amendments to the application for this grant award, and the execution of any grant agreement from the earliest of the dates of application submission, acceptance of the funds, or execution of any pertinent grant agreement or document to the date of the adoption of this authorizing Resolution.
4. The city will provide an in-kind match of Forty-Nine Thousand Five Hundred Forty-Three Dollars and Forty-Four Cents ($49,543.44).
5. The Director of the Department of Water and Sewer shall file in the Office of the City Clerk a full executed copy of the Grant Agreement, and any other documents relating to the grant.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Business Administrator, and the Director of the Department of Water and Sewer to apply for and accept grant funding from the New Jersey Department of Environmental Protection (NJDEP), 501 E. State Street, Trenton, NJ 08625, in the amount of Fifty-One Thousand Nine Hundred and Eighty Dollars and Zero Cents ($51,980.00), with an in-kind match of the Grant Funds in the amount of Forty-Nine Thousand Five Hundred Forty-Three Dollars and Forty-Four Cents ($49,543.44), and to execute any agreement necessary to receive and expend the grant funds. The grant funds are to perform impervious area data development services.
