WHEREAS, pursuant to a fair and open process Resolution 7R12-b adopted on June 7, 2023, authorized the Director of the Department of Water and Sewer Utilities, to enter and execute a contract with Kleinfelder, Inc., 150 College Road West, Suite 100, Princeton, New Jersey 08540, to provide Professional Engineering Services for High Service Pumps and Additional Filters at the Pequannock Water Treatment Plant, in an amount not to exceed $895,000.00, commencing from the date of an issuance of a Notice to Proceed to the completion of construction, pursuant to N.J.S.A. 40(A):11-15(9); and
WHEREAS, the City of Newark, is currently in the process of installing high speed pumps and additional filters number 12 and 14 at the Pequannock Water Treatment Plant with the managerial assistance of Kleinfelder, Inc. The City and Kleinfelder have agreed to revise the scope of services to include high service pump scope removal, additional approval efforts, construction phase foundation redesign and resident construction observation; and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Amendment #1 for an increase of the contract amount by $215,327.00 with Kleinfelder, Inc., to continue providing Professional Engineering Services for High Service Pumps and Additional Filters at the Pequannock Water Treatment Plant, until project completion per N.J.S.A. 40A:11-15(9) as more fully set forth in the scope of the services detailed in the attached Kleinfelder letter dated November 24, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Amendment #1 with Kleinfelder, Inc., 150 College Road West, Suite 100, Princeton, New Jersey 08540, to continue to provide Professional Engineering Services for High Service Pumps and Additional Filters, revise the scope of services to include high service pump scope removal, additional approval efforts, construction phase foundation redesign and resident construction observation at the Pequannock Water Treatment Plant, for an additional $215,327.00, for a total contract amount not to exceed $1,110,327.00 until project completion per N.J.S.A. 40A: 11-15(9).
2. Pursuant to N.J.A.C. 5:30-5.5(a), Temporary Budget, attached hereto is a partial Certification of Funds issued by the Director of the Department of Finance, which state that there are available sufficient legally appropriated funds in the amount of $5,000.00 for the purposes set forth herein, under NW037-750-7502-71280-B2026 the certification shall be filed along with the original resolution in the Office of the City Clerk. The remainder of the funding for this contract will be subject to appropriation in the 2026 Budget and funds will be certified prior to services being provided by the contractor.
3. The Director of the Department of Water and Sewer Utilities shall file a duly executed copy of Amendment #1 in the Office of the City Clerk.
4. All other terms and conditions of the Contract remain the same.
5. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.
STATEMENT
This Resolution ratifies, amends and authorizes the Mayor of the City of Newark and/or his designee, the Department of Water and Sewer Utilities, to enter into and execute Amendment #1 with Kleinfelder, Inc., 150 College Road West, Suite 100, Princeton, New Jersey 08540, to continue to provide and revise the scope of work for Professional Engineering Services for High Service Pumps and Additional Filters at the Pequannock Water Treatment Plant, for an additional $215,327.00 for a total contract amount not to exceed $1,110,327.00, until project completion per N.J.S.A. 40A: 11-15(9).
