WHEREAS, the Department of Public Safety is desirous of evaluation and planning the feasibility of establishing a Mini Precinct at 516-566 Roseville Avenue, Newark, New Jersey 07107, a property owned by the Newark Public Schools; and
WHEREAS, the Department of Public Safety has indicated its need for ingress and egress to the Property for the purpose of conducting all pre-construction site analysis activities, and approving this Hold Harmless and Indemnification Agreement by the City of Newark Insurance Fund Commission for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, is required to begin the process; and
WHEREAS, the Newark Public Schools requires the City of Newark to submit a Hold Harmless and Indemnification Agreement in favor of the Newark Public Schools; and
WHEREAS, the Newark Municipal Council supports a Hold Harmless and Indemnification Agreement for the Department of Public Safety’s evaluation and planning the feasibility of establishing a Mini Precinct at the Newark Public Schools located at 516-566 Roseville Avenue, Newark, New Jersey 07107, a property owned by the Newark Public School; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for any claims arising out of the City of Newark’s use of 516-566 Roseville Avenue, Newark, New Jersey 07107, commencing January 8, 2018 and terminating February 28, 2018.
2. The Municipal Council of the City of Newark further supports the issuance of a related Certificate of Self -Insurance by the City of Newark’s Insurance Fund Commission in the form attached hereto.
3. The Director of the Department of Public Safety shall forward the executed Hold Harmless and Indemnification Agreement and the Certificate of Self-Insurance to the Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102.
4. A copy of the executed Hold Harmless and Indemnification Agreement and the Certificate of Self Insurance shall be filed in the Office of the City Clerk by the Director of the Department of Public Safety.
STATEMENT
This resolution supports the issuance, by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement for the benefit of Newark Public Schools, 765 Broad Street, Newark, New Jersey 07102, for any claims arising out of the City of Newark’s use of the facility at 516-566 Roseville Avenue, Newark, New Jersey 07107 for the evaluation and planning the feasibility of establishing a Mini Precinct at 516-566 Roseville Avenue, Newark, New Jersey 07107 commencing January 8, 2018 and terminating February 28, 2018.
