Original Resolution 7R1-c, adopted on May 18, 2022, awarded a bid contract to provide Medical and Laboratory Services (testing), for an amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00), for a period of twenty-four (24) consecutive months.
This amendment will increase the contract amount by One Million Three Hundred Eighty Thousand Dollars and Zero Cents ($1,380,000.00) for a total contract amount not to exceed One Million Nine Hundred Eighty Thousand Dollars and Zero Cents ($1,980,000.00) to accommodate the increased population using the three mobile medical vans and the new access point for school based clinic at Speedway Avenue.

WHEREAS, on May 18, 2022, the Municipal Council adopted Resolution 7R1-c, authorizing the Purchasing Agent, QPA, to enter into a contract with LabCorp, 69 First Avenue, Raritan, New Jersey 08869, to provide Medical and Laboratory Services (Testing), at an amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00), for twenty-four (24) consecutive months; and
WHEREAS, the contract with LabCorp was executed with the contract term commencing August 15, 2022 and terminating August 14, 2024; and
WHEREAS, the City of Newark Department of Health and Community Wellness has requested an additional amount of One Million Three Hundred Eighty Thousand Dollars and Zero Cents ($1,380,000.00) to accommodate the increased population using three mobile medical vans and the new access point for school based clinic at Speedway Avenue; and
WHEREAS, the Purchasing Agent, QPA, recommends that the Municipal Council authorize the amendment of Resolution 7R1-c, adopted on May 18, 2022, to increase the not to exceed amount by One Million Three Hundred Eighty Thousand Dollars and Zero Cents ($1,380,000.00), as requested by the Director of the Department of Health and Community Wellness, in the attached memo, for an amended not to exceed amount of One Million Nine Hundred Eighty Thousand Dollars and Zero Cents ($1,980,000.00), to provide Medical and Laboratory Services (Testing); and
WHEREAS, all other terms and conditions remain the same.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-c, adopted on May 18, 2022, awarding a contract to LabCorp, 69 First Avenue, Raritan, New Jersey 08869, at an amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00) is hereby amended to increase the contract amount to One Million Nine Hundred Eighty Thousand Dollars and Zero Cents ($1,980,000.00).
2. This resolution is ratified from August 15, 2022 to the date of adoption of by the Municipal Council.
3. There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2023 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d)(2).
5. All other terms and conditions of the original agreement shall remain unchanged.
6. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: Department of health and Community Wellness NW026-026-46545-B2023. This contract shall not exceed the amended amount of One Million Nine Hundred Eighty Thousand Dollars and Zero Cents ($1,980,000.00) for one (1) vendor for the period commencing August 15, 2022 through August 14, 2024, as per the terms and conditions of the original agreement.
7. The Purchasing Agent, QPA shall file a duly executed copy of the contract in the Office of the City Clerk,

If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes and ratifies the amendment of Resolution 7R1-c adopted May 18, 2022, awarded to LabCorp, 69 First Avenue, Raritan, New Jersey 08869, by increasing the contract not to exceed amount to One Million Nine Hundred Eighty Thousand Dollars and Zero Cents ($1,980,000.00) for the contract period commencing August 12, 2022 through August 15, 2024, to provide Medical and Laboratory Services (Testing). All other terms and conditions of the original agreement to remain unchanged.
