WHEREAS, the City of Newark’s Department of Health and Community Wellness (hereinafter, “DHCW”), Ryan White Unit, desires to continue to provide Ryan White health, social and related services for HIV/AIDS-infected individuals and families residing in the Newark Eligible Metropolitan Area (NEMA), which is comprised of Essex, Union, Morris, Sussex and Warren counties in northern New Jersey; and
WHEREAS, the United States Department of Health and Human Services, Health Resources and Services Administration (HRSA) located at 5600 Fishers Lane, Rockville, Maryland 20857, has made funds available for the provision of these services; and
WHEREAS, on January 8, 2025, the Newark Municipal Council adopted Resolution 7R5-c authorizing the October 1, 2024 application and acceptance of The Ryan White HIV/AIDS Program (RWHAP) Part A HIV Emergency Relief Grant Program Award (“Grant Award”) in the amount of Eight Million Three Hundred Sixty‑Nine Thousand Five Hundred and Five Dollars and Zero Cents ($8,369,505.00), for the continued provision of Ryan White health, social and related services for HIV/AIDS-infected individuals and families residing in the City of Newark and the NEMA, for the grant period commencing on March 1, 2025 and terminating on February 28, 2026. This Grant has a three (3) year performance period commencing on March 1, 2025, and terminating on February 28, 2028. Non-competing continuation (NCC) progress reports will be submitted for contract renewals in years two and three (FY2026 and FY2027) in lieu of a competitive application;and
WHEREAS, on or about September 29, 2025, the Director of the DHCW submitted a non-competing continuation (NCC) progress report in the amount of Twelve Million, Eight Hundred Seventy-Nine Thousand, Two Hundred Fifty-One Dollars and Zero Cents ($12,879,251.00) to HRSA for FY2026, year two (2) of the multi-year performance grant; and
WHEREAS, as a result of the submission, HRSA provided the City with an estimate of the total formula award (“Grant Funds”) in the amount of Seven Million, Nine Hundred Eighty-Six Thousand, Three Hundred Thirteen Dollars and Zero Cents ($7,986,313.00), for the continued provision of Ryan White HIV health and social services for people with HIV residing in the NEMA area, for the grant period commencing on March 1, 2026, and terminating on February 28, 2027, year two of the multi-year grant; and
WHEREAS, the DHCW desires to accept said Grant Funds in the amount of Seven Million, Nine Hundred Eighty-Six Thousand, Three Hundred Thirteen Dollars and Zero Cents ($7,986,313.00); and
WHEREAS, HRSA does not require the City to execute a grant agreement in order to accept the aforementioned grant award; and
WHEREAS, the City recognizes that HRSA may extend the time of the Grant Award and will provide additional funding when it becomes available; and
WHEREAS, HRSA will amend the grant to reflect any time extension and/or award of additional funding if made available.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark (“City”), and/or his designee, the Business Administrator, and/or the Director of the Department of Health and Community Wellness, are authorized to accept the Grant Funds in the amount of Seven Million, Nine Hundred Eighty-Six Thousand, Three Hundred Thirteen Dollars and Zero Cents ($7,986,313.00) from the United States Department of Health and Human Services (HRSA) for the continued provision of Ryan White HIV related health, and social services for People with HIV residing in the Newark Eligible Metropolitan Area (NEMA), for the Grant Period commencing on March 1, 2026 and terminating on February 28, 2027 as a result of the Non-competing continuation (NCC) progress reports submission for year two (2) of the Multi-Year Performance Grant Period. No City funds required for receipt or acceptance of the grant funds (a copy of the NCC Progress Report and the Notice of Award is attached hereto and made a part hereof).
2. The Mayor of the City, and/or his designee, the Business Administrator, and/or the Director of the Department of Health and Community Wellness, are authorized to receive and expend the grant award through Request for Proposals (RFPs), for the continued provision of Ryan White HIV related health, and social services for People with HIV residing in the NEMA, for the period commencing on March 1, 2026 and terminating on February 28, 2027 (a copy of the grant award is attached hereto and made a part hereof).
3. This Grant has a three (3) year performance period commencing on March 1, 2025, and terminating on February 28, 2028. The Mayor of the City, and/or his designee, the Business Administrator, and/or the Director of the Department of Health and Community Wellness, is authorized to request and accept non-competing continuation (NCC) progress reports from each contracted sub-recipient and vendor for contract renewals / awards in years two and three (FY2026 and FY2027) in lieu of a competitive application that are subject to Municipal Council approval.
4. The authorization granted herein is ratified back to September 29, 2025, from the date of adoption of this Resolution by the Municipal Council of the City of Newark.
5. HRSA may extend the time of the Grant Award and may provide additional funding when it becomes available. This Resolution authorizes the acceptance of all additional Grant Funds awarded in connection to the above referenced Grant Application and continued Non-competing continuation (NCC) progress report submissions for the Grant Period of March 1, 2026 through February 28, 2027.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the Non-competing continuation (NCC) progress reports and the Notice of Grant Award Letter in the Office of the City Clerk.

This Resolution ratifies and authorizes the actions taken by The Mayor of the City, and/or his designee, the Business Administrator, and/or the Director of the Department of Health and Community Wellness, to accept grant funds in the amount of Seven Million, Nine Hundred Eighty-Six Thousand, Three Hundred Thirteen Dollars and Zero Cents ($7,986,313.00) from the United States Department of Health and Human Services (HRSA) for the continued provision of Ryan White HIV related health, and social services for People with HIV residing in the Newark Eligible Metropolitan Area (NEMA), for the Grant Period commencing on March 1, 2026 and terminating on February 28, 2027 as a result of the Non-competing continuation (NCC) progress reports submission for year two (2) of the Grant Period. Non-competing continuation (NCC) progress reports will be submitted for contract renewals in years two and three (FY2026 and FY2027), in lieu of a competitive application and subject to Municipal Council approval. No municipal funds are required for receipt or acceptance of this grant award.
